지방선거의 문제점과 개선방안

대표성은 권력의 정당성을 제공하는 기반이다. 지방선거에서는 선거에 대한 무관심과 투표율의 감소가 뚜렷해지면서, 투표율의 하락으로 인한 대표성의 위기현상의 초래되고 있다. 선거에서의 무관심은 선거의 과잉, 후보자 선택에 관한 열정의 부족, 미디어, 교육, 정치적 성향 등 다양한 원인에서 기인할 수 있다. 지방선거에서 유권자의 무관심과 대표자의 대표성의 회복하는 것은 지방자치제도의 성공적인 정착을 위한 필수불가결한 전제이다. 그러한 방안으로 논의되는 것으로 강제선거의 도입문제를 들 수 있다. 상당수의 나라에서는 강제투표적 요소를 도입하고 있다. 하지만 강제투표 자유선거원칙이나 표현의 자유와 관련하여 헌법위반적 요소가 지적된다. 유권자가 자신의 의사에 반하여 투표를 하도록 가야 한다면 그것은 선거의 자유가 보장된다고 할 수 없으며, 유권자의 결정의 자유를 침해하는 것으로 자유선거의 원칙에 반한다는 것이다. 또한 투표의 강제는 헌법상의 표현을 하지 않을 권리에 대한 강제이며, 그것은 소극적 표현의 자유에 위배된다는 주장도 지배적이다. 이러한 헌법위반적 요소에도 불구하고, 제도적 개선을 통해 강제선거의 도입필요성이 제기되고 있다. 그 밖에 유권자의 무관심과 선거에서의 대표성을 회복하기 위한 방안으로 논의되는 것으로는 선거과잉현상을 해결하기 위한 방안으로 지방정부의 의원내각제를 도입하는 방안, 투표시간 및 투표방법적 접근을 통하여 투표율을 상승시키는 방안, 미디어 선거의 긍정적 효과를 제고하는 방안, 정당 내부의 후보자 선출과정의 민주성과 투명성을 보장하는 방안, 지방정당의 설립방안, 후보자선출에 있어서 정당의 관여를 배제하는 방안 등이 논의된다.

If scarcely half of the population of eligible voters turns out for a local election, it becomes difficult to defend local democracy as truly representative. Voter turnout has been inching downward in the local elections. Low voter turnout might reasonably be blamed on "apathy". So in this paper, I would like to suggest the method for curing voter apathy. As the method for curing voter apathy, it might be discussed whether the compulsory voting could be chosen. Twenty -four nations employ an electoral model that incorporate some element of compulsory voting, for example compulsory enrollment, compulsory preference. There is no doubt that compulsory voting, coupled with a modest nonvoting penalty, would be increase voter turnout in the local elections. But it was a controversial subject. Above all, compulsory voting will almost surely bring a challenge based upon the freedom of speech, especially "right to refrain from speaking". Also compulsory voting can hardly be free from doubt of violation against the freedom of election. According to the constitutional theory in Germany, compulsory voting could not be adopted, because of the violation against the freedom of election. In On the other hand it is claimed that the scheme of compulsory voting might be able to avoid by choosing the "none of the above option". It is said that, by removing the necessity to endorse a particular viewpoint or candidate, the "none of the above option" potentially undermines the argument that compulsory voting is compelled speech. Besides, it might be discussed as the method for curing voter apathy, extending the polling hours, using the multimedia for the positive aspect of a situation, reducing the number of the election, improving the nominating process of the candidate.
