민주주의의 전제조건에 관한 고찰

A Study on the Prerequisite of Democracy -Centered on Thesen Böckenförde-

민주주의 관련 규정들이 그 자체 지향하고 있는 이념을 가지고 있고 해당 규정들이 그 이념을 실현하기 위한 수단으로서의 성격을 지닌다면, 이념실현을 위해 자명하게 전제된 여타의 쓰여지지 않은 전제조건을 상정하는 것 역시 가능하다. 그렇다면 이러한 전제조건이 갖추어지지 않은 상태에서 이루어지는 민주주의 관련 실정 법규정의 준수는 때론 민주주의 이념의 온전한 실현을 위해 충분치 않는 상황 역시 있을 수 있게 된다. 따라서 국가의 민주적 정당성의 수준을 높이고자 하는 법률가라면 이와 같이 쓰여지지 않은 전제조건을 법적 논의의 한 부분으로 끌어안고 그 충족을 위해 같이 고민할 필요가 있다. 이를 위한 법적 연구의 기반 마련 차원에서 본고는 민주주의의 씌여지지 않은 전제조건에 대한 뵈켄회르데의 테제를 살펴보고 이들 조건의 구체적 내용과 상호견련관계에 대한 파악을 위해 민주주의 관련 실정규범 배후의 이념이 무엇인지, 그리고 그 이념 실현을 위한 구체적 메커니즘이 무엇인지를 여러 이론적 입장들에 대한 유형화와 함께 검토해 보았다. 그리고 이들 이론적 유형화 각각에 비추어 뵈켄회르데가 말한 씌여지지 않은 민주주의의 전제조건들이 어떠한 구체적 내용과 비중으로 요구되고 또 이들이 어떠한 상호 견련관계에 놓이게 되는지를 분석해 보았다. 마지막으로 추가적 연구가 필요한 부분들을 검토해 보면서 민주주의의 전제조건에 대한 이론적 분석이 한국 법현실에서 가질 수 있는 함의에 대한 분석을 주요한 연구과제로 제시하며 글을 마무리 지었다.

If there's a spirit which democracy related positive norms supports and if the related positive norms have a character as a means of realizing this spirit, other unwritten prerequisite, which is obviously needes in sprit realization also can exist. If so, an observance of democracy related positive legal norms in a state that such prerequisite is not prepared could be not enough for a sound realization of democracy. Therefore, a lawyer who intends to raise the standard of national democratic legitimacy needs to embrace such unwritten prerequisite as a part of legal study and share worry about the satisfaction thereof. In the dimension of the preparation for the basis of such legal study, this manuscript first tried to materialize various theoretical positions so far, to give shape to public autonomy which can be the theoretical background and spirit of democracy, and then examine E.-W. Böckenförde's argument about the unwritten prerequisite of democracy. Also, in order to examine how much degree of importance those prerequisites actually require and how much that interrelation can be set, implications of unwritten prerequisites were compared and analyzed in the light of previously materialized theoretical positions. Lastly, this manuscript was finalized by briefly examining implication which such theoretical analysis about democratic prerequisite can have in Korean legal reality.
