지방자치단체의 인권 제도화에 관한 연구

A Study on Human Rights Institutionalization of Local Government -Focused on Plan for the Promotion of Human Rights and Human Rights Impact Assessment-

2012년 4월 국가인권위원회는 각 지방자치단체의 장에게, 국가인권위원회가 제시하는 인권기본조례 표준안을 참조하여 인권기본조례를 제정할 것을 권고하였다. 권고시 인권 기본조례 제정의 취지, 지방자치단체의 역량 등을 고려하여 조문 형식의 표준안을 제시하였는데, 그 내용은 조례의 목적이나 지자체의 장의 책무, 인권보장 및 증진 기본계획 수립과 정책, 인권보장 및 증진위원회 설치 및 업무, 운영 등에 관한 사항이다. 본 논문에서는 인권조례 표준안 권고의 필요성, 표준안의 내용, 권고의 의미 그리고 권고가 피권고기관에 어떻게 작동하는지에 대하여 분석하였다. 이러한 국가인권위원회의 권고에 따라 피권고기관 244개 기관 중 권고를 수용한 기관은 177개 기관으로 인권기본조례를 제정하였거나, 제정 계획을 수립하였다. 본 논문에서는 인권기본조례가 지역의 특수한 사정을 고려하여 인권의 보편적 가치를 실천하고자 하는 우리 사회의 구체적인 변화에 부응하고, 국가인권위원회 권고의 취지에 부합되도록 하기 위해서 인권기본조례의 제정과정에서 지켜져야 할 고려사항과 인권기본조례상 인권증진기본계획의 수립과 인권영향평가제도 도입시 고려해야 할 사항을 제시하고 있다. 본 논문에서는 인권기본조례가 지역의 특수한 사정을 고려하여 인권의 보편적 가치를 실천하고자 하는 우리 사회의 구체적인 변화에 부응하고, 국가인권위원회 권고의 취지에 부합되도록 하기 위해서 인권기본조례의 제정과정에서 지켜져야 할 고려사항(주민의 의견수렴, 인권상황실태조사, 인권교육 등)과 인권기본조례상 인권증진기본계획의 수립과정에서 고려해야 할 사항(지역의 특수성, 단위과제, 지속적인 소통 등), 그리고 인권영향평가제도 도입시 고려해야 사항(기존 제도의 연계, 평가대상의 선정기준과 원칙 등)을 제시하고 있다.

On April, 2012, National Human Rights Commission of Korea(NHRCK) suggested that each local government head should establish a human rights ordinance referring to the standard of human rights ordinance recommended by NHRCK. The contents of the recommendation contain a purpose of ordinance, a duty of chief local government, a primary plan and policy on human rights protection and improvement, the establishment, work and management of human rights promotion and protection committee. This recommendation is written in the light of the purpose of the enactment of human rights ordinance and the capacity of local government maintaining the form of a provision. This paper analyzed the necessity of the recommendation of human rights ordinance standard, the content of the standard, the meaning of decisions recommended by NHRCK and how the recommendation works on organizations accepting it. In compliance with the decisions recommended by NHRCK, 177 out of 244 organizations accepted them establishing human rights ordinance.(acceptance rate 72.5%) This paper suggests that human rights ordinance should meet the concrete change of our society that is willing to practice the universal value of human rights, considering the specific situation of a region. To meet the purpose of decisions recommended by NHRCK, this paper suggests considerations that should be observed on the process of making human rights ordinance(acceptance of residents' opinions, research on human right situations and human right education) and decisions that should be considered at the time of establishment of the plan for the promotion of human rights(a region's specialty, unit assignment, continuous communication) and introduction of human rights impact assessment(connection to the existing policies, standard and rule of selection of a evaluation target).
