언론인의 정의는 언론의 자유를 보호하거나 규제하기 위한 목적을 가진 법을 만들 때는 물론 적용할 때도 많은 논란을 불러일으킨다. 그 범위에 따라 법의 보호 및 특혜 대상 또는 규제 대상이 될 수도 있고 안 될 수도 있기 때문이다. 미국에서 법률상 언론인의 정의가 필요했던 것은 언론인을 보호하고 언론인에게 혜택을 주기 위해서였다. 언론인들이 비밀 취재원에 관한 법정 증언과 자료 제출을 거부할 수 있는 '언론인의 특권'이란 개념을 담은 방패법이 만들어지면서 그 특권의 수혜 자격을 가진 사람의 범위를 정할 필요가 생겼다. 미국에서 언론인의 특권을 규정한 방패법을 만들 때 누가 기자인가를 결정하는 것은 간단한 문제가 아니었다. 입법의 걸림돌은 '언론인'에 대한 정의의 불확실성이었다. 물론 신문, 방송 등 전통언론의 시대에는 별 문제가 없었다. 이러한 불확실성의 가장 큰 원인은 디지털 언론 환경 때문이다. 한국은 미국과 달리 언론인을 규제하기 위한 목적으로 언론인을 법으로 정의했다. 한국에는 '언론인의 특권'을 인정하는 방패법이 없다. 대신 언론인의 입후보와 선거운동을 제한하는 공직선거법에서 언론인의 범위를 규정하고 있다. 미국에서도 많은 논란이 빚어지고 있는 언론인의 범위를 학계나 언론계와의 논의 없이 정부가 일방적 입법으로 결정했다. 이처럼 한국에서의 언론인의 정의에 관한 문제는 미국에서 벌어지고 있는 논란의 방향, 내용과는 전혀 다르다. 이 논문은 한국과 미국의 법률이나 법원들이 언론인을 어떻게 정의하고 있는지를 비교 연구한다.

In the United States, advocates of a long-debated proposal to protect reporters from legal action for not revealing their sources are facing a complex question: Who is a journalist? The debate has been focused on what rules should protect reporters from excessive government efforts to track down their sources of information and compel their testimony in legal proceedings. The emergence of citizen or grassroots journalism inevitably raises the question of whether bloggers, the operators of online news sites, or even freelancers should be considered journalists with the same legal rights as reporters who are employed by traditional news organizations. Defining what is a 'journalist' has become more complicated as the variety of media has expanded. In Korea, that kind of debate has never occurred because the legal definition of journalists was made exclusively by the government not to protect but to regulate them. Korea does not have a legal mechanism equivalent to the media shield law of the U.S. This comparative paper studies how differently statutory laws and courts decisions in Korea and the United States define a journalist.
