유럽과 한국의 ODA 규범비교

A Comparative Study on the European ODA Law and the Korean Law

한국은 국제사회에서의 역할강화와 함께 ODA 활동에 많은 역량을 집중하고 있다. ODA 관련 국제규범은 국내규범에 많은 영향을 주며, 많은 국가들은 성문화된 형태의 국내법을 제정하여 ODA 활동을 규율한다. 한국의 ODA 활동 역시 국내외 규범의 규율대상이 되고 있으며, 향후 여러 면에서 연구와 보완이 필요한 상황이다. ODA의 오랜 역사를 가진 유럽의 선진국들은 해외원조와 국제협력을 위한 규범들을 발전시켜왔고, 축적된 경험과 각자의 특성을 잘 반영한 규범을 구축하여 국제규범과 국내규범의 조화를 실현하고 있다. 유럽 국가들의 ODA 규범들은 여러 가지 형태로 나타나고 있으나, 일반적으로 원조의 기본목표 및 정책방향을 제시하고, 원조형태 및 대상, 시행기관의 역할과 위상, 중점지원국 및 지원 분야, 민간단체 지원 및 자문기관 등 세부 추진계획을 주요 내용으로 한다. 한국은 2010년 OECD DAC의 권고를 받아들여 국제개발협력기본법을 마련하여 ODA 관련 법적 기본체계를 제공하고 있다. 이 법은 한국 ODA의 기본이념과 목표를 설정하며, 정부의 역할과 정책설계의 절차 및 범위를 규정하고 있다. 국제개발협력기본법을 바탕으로 한국의 ODA 규범들은 외교부-KOICA의 무상원조와 기획재정부-한국수출입은행의 대외경제협력기금운용 활동에 대한 법적 근거를 구축하였다. 유럽의 규범내용과 비교할 때, 한국의 ODA 관련 규범이 국제규범에 완벽하게 합치하고 있는가에 대해서는 의문이 있으며, 몇 가지 개선할 점을 찾을 수 있다. 이 글에서는 유럽 ODA 선진국들의 관련 국내규범의 전반적인 내용들을 살펴보고, 그 특성을 파악한 후 한국의 ODA 규범에 반영할만한 사안들을 제안하였다.

After the joining to the OECD DAC in 2009, Korea enacted the International Development Cooperation Act in 2010 as the basic domestic law for the Korean ODA works. The government established the suitable ODA legal system to meet international standards. Then, other Korean rules are related together based on the principles in the International Development Cooperation Act. However, there are many critical opinions on the Korean laws on their ODA. Some ambiguous provisions in the laws, government focused or centred ODA structures without consideration of the civil roles and no effective evaluation systems are examples of the criticism. With the long history and many experiences, the european countries have developed the ODA rules or the laws on the international development cooperations. They are harmonised well with the international rules and have good provisions for the consistence of their own ODA policies. To make up the legal problems in the Korean ODA laws, many dimensions in the European ODA rules are considerable. They are focused on certain concepts and purposed in relation to the main policies. Many provisions in the domestic laws on their ODA works can be good models for the improvement of the Korean laws and polices.
