학교에서 학생의 표현의 자유에 대한 연구

본 논문은 비교적 짧은 기간에 민주주의가 발전하여 왔으며 개인의 자유와 권리가 크게 신장된 한국사회에서의 학생의 표현의 자유에 대한 연구이다. 이를 위해 먼저 오늘날의 한국사회가 지향하고 있는 민주주의 사회에서 표현의 자유가 갖는 가치와 중요성을 보여주는 세 가지 철학적 논의를 살펴보고, 이어서 학생의 표현의 자유가 학교라는 특수한 상황에서 어떻게 이해되어지고 적용되어야 할 것인지에 대해 분석하였다. 학생의 표현의 자유와 관련하여서는 구체적으로 우리나라 학교가 가지는 특수한 환경이 무엇인지를 알아보고 그 특성들이 학생의 표현의 자유를 장려하는지 아니면 제한하는지를 살펴보았다. 본 연구는 학교라는 특수한 상황이 학생들의 표현의 자유를 보호해야 하는 이유가 있으면서도 동시에 학생들의 표현의 자유를 제한해야 하는 이유가 있음을 보여주었다. 그럼에도 불구하고 학교라는 특수한 상황이 갖는 특성에 의해 학생의 표현의 자유를 제한해야 한다면, 학교는 여전히 학생들의 목소리를 존중하고 있음을 보여주는 교육적인 방법으로 제한하여야 함을 제의하였다.

In this paper, we examine student speech rights in contemporary Korea, a land in which there has been an upsurge in democratic aspirations in both society and education during recent decades. We first establish the reasons why freedom of expression is important in democratic societies and then consider how the special characteristics of Korean schools might transform student free speech in Korean schools. From the analysis, we suggest that the several characteristics of schools in the Korean setting have mixed implications for student speech rights. Specifically, while the characteristics of Korean schools give some reasons to protect student speech, they also show that there are strong reasons to limit it. Despite there being circumstances in which student voices might need to be controlled because of the needs of a school environment, the special environment of schools reminds us that schools must take student rights seriously in order to fulfil their educational mission.
