민간조사제도에 관한 비교법적 고찰

현대사회의 복잡성과 다양성으로 인해 국민들의 권리구제와 피해회복을 위한 사실관계 조사의 필요성은 점차 증대되고 있음에도 불구하고 국가의 수사력은 시간적ㆍ물리적으로 한정되어 있다. 이에 다양한 범죄 행태에 대해 신속하게 범인을 검거하고 피해상황을 파악하기 어려운 경우가 발생한다. 이런 경우 민간조사 즉 사설기관에 의뢰해 문제 해결을 시도하다보니 각종 불법행위가 자행되거나 자력 구제를 도모하다가 또다른 범죄를 저지르게 되는 경우가 빈번하게 발생하고 있다. 일반 국민들은 현재 변호사에 의한 고비용 법률서비스만으로 그 수요를 충족시킬 수 없기에 민간조사가 비공식적으로 자행되고 있다. 또한 사실조사 서비스 등의 필요성으로 인해 용역서비스가 이루어져 왔으나 자유업 형태로 이루어지다 보니 실제 합법적인 대행업무 외에 불법행위도 자행함에 따라 사회문제가 되고 있다. 아울러 영세업체들이 난립함으로써 용역을 제공받고자 하는 국민이 오히려 의뢰 시 제공했던 정보로 인해 사생활 침해를 받을 우려가 있으며, 합법을 가장한 인권침해 등의 불법행위 심화, 국가형벌권 감소로 인한 사법정의 퇴색, 빈부 격차로 인한 양극화 심화, 새로운 직종으로 인한 갈등 우려 등의 문제도 동시에 발생하는 사례가 늘어나고 있다. 결국, 민간조사제도의 도입은 외국의 입법례를 참고하여 최근 논의되고 있는 입법안을 심도 있게 검토하고, 민간조사제도를 통해 보호 및 침해받을 수 있는 권익에 대한 비교형량 등을 종합적으로 고려하여 판단해야만 한다.

amage recovery has increased with complexity of the modern society. However, the investigation capacity are limited in time and physical situation. Therefore, it is difficult to recognize the situation and to arrest criminals quickly in terms of variety of crimes. In this case, some people request to a private investigation in order to solve problems. Under this situation, illegal activities or even criminal activities occur frequently. Citizens' demand cannot be satisfied because of the high cost legal-service by lawyers and thus private investigation proceed informally. That is, the service has involved in a form of private, illegal activities are committed above legal agency business. It is a big social problem. Also, there are small agencies all over and it makes the situation worse. Citizen could have significant privacy concerns due to providing their personal information to the agencies. Illegal activities such as human right abuse could be happened. The definition of justice could be faded because of the decrease of punishment power. With regard to the introduction of private investigation system, it is necessary that other countries' law should be considered and laws that have been recently discussed should be reviewed profoundly.
