The Current Trends of Voice Phishing Fraud: Legislation and Policy Implication

The methods to Voice Phising Fraud is getting more skillful and sophisticated. Mortgage frauds like 'Card Loan'which is one of the variants of Voice Phishing Fraud are causing great deal of damage. This situation calls for legislative supplementation and intensification of punishment. Current statute can only be applied restrictively so the broadened scope of regulation has been suggested regarding legislative supplementation. The accusation of Voice Phishing Fraud is impossible because Voice Phishing Fraud, the conduct itself does not constitute a crime with the fact that most of the victims even do not recognize that they had been targeted. Therefore, it implies that the revised regulation is needed. Focusing on ⅰ) the regulations that can control and be applied to variant form of Voice Phishing Fraud such as'Card Loan' and ⅱ) the international trends in regulating those kind of fraud, this article aims at examining the validity of enacting laws and international trends in legislation regarding Voice Phishing Fraud.
