제임스 뷰캐넌의 ‘헌법경제학’에 대한 가톨릭 사회윤리의 성찰

The Study of "Constitutional Economics" of James Buchanan through the View of Catholic Social Ethics : towards the Establishment of Basic Values and Direction of Economic Democracy

경제민주주의는 시장의 자유와 정치 민주주의를 포괄한다는 의미를 갖는다. 이 제도는 자유시장경제와 국가개입주의를 넘어서는 새로운 대안으로 제시된다. 이런 맥락에서 자유시장의 실패와 국가의 실패 모두를 염두에 두고 경제학을 전개한 제임스 뷰캐넌의 이론은 주목받을 만하다. 뷰캐넌이 경제민주주의에 이바지 하는 바가 있다면, 시장과 국가를 규제하는 제도로서 헌법의 중요성을 강조했다는 점과 민주주의 사상을 근간으로 시민들의 공공선택에 의한 헌법적 개혁의 가능성을 제시했다는 점이다. 공공선택은 모든 시민들의 사회적 상호작용에 제약을 두는 헌법이 되기 때문에, 헌법개혁을 통해 시장과 국가의 부당성을 극복할 수 있다는 것이다. 그러나 그가 상정한 경제의 주체인 ‘합리적 개인(homoeconomicus)’은 자신의 이익과 관계없는 헌법적 개혁에 참여할 개연성은 별로 없다. 그의 이론은 경제민주화를 포괄적 민주주의를 향한 과정으로 보는 전망 안에서 수정되었다. 포괄적 민주주의는 경제적 합리성과 사회적 합리성을 포괄하는 통합적 합리성, 인간의 총체적 차원에서의 욕구 이해, 시민들의 자발적 연대성, ‘시장, 국가, 시민사회’의 제도적 구성을 전제하는 체제이다.

The meaning of economic democracy is the combination of free market and political democracy. This system is suggested as a new alternative that gets over the failures of free market economy and the government involvement systems. In this context, it is worth taking note of the theory of Buchanan who developed his economics having both failures of free market and state in his mind. The contribution of the theory of James Buchanan to economic democracy is the emphasis on the constitution as the institution to regulate the market and state, and the suggestion of the possibility of the constitutional revolution through the public choice based on the democratic thoughts. But 'homo economicus' which is the basic premise of 'constitutional economics' couldn't have the probability to attend in the constitutional revolution without one's own profit. The Buchanan's theory is criticized from the vision that the economic democratization should be the process to an inclusive democracy. An inclusive democracy is the system that has a premise in inclusive rationality, the whole needs of humans, the voluntary solidarity of citizens and the institutional composition of ‘market, state, and civil society’.
