A Study on the Activation of the Mediation of the Industrial Property Disputes

With the enactment of the Basic Act on Intellectual Property, it is expected that the Alternative Dispute Resolution (ADR) will be used more frequently in the field of intellectual property law. Pursuant to the Invention Promotion Act, the Industrial Property Mediation Committee was established under the auspices of the Korean Intellectual Property Office (KIPO), but the mediation remains very inert due to the limited scope of the subject matter, lack of a standing member of the committee and weak publicity. Therefore, in order to activate the mediation, the scope of the subject matter of it on should be broadened to include some administrative dispute (e.g., invalidation case). Also, a standing member of the committee and on-line mediation should be introduced into that system. Arbitration could be considered as a part of the Committee's ADR program.
