A Review Regarding Problems on Korean Patent System (IV) -In regard to Patent Bar Examination-

Korean Patent Bar Examination consists of a preliminary multiple choice type test for three courses, intellectual property law, civil law, and common science course, and a final essay type test for four courses, patent law, trademark law, civil procedure, and an optional subject. In the preliminary test, the common science course should be dropped out form the courses. Instead, an optional course should be selected among five fields, (1) Electric and electronic engineering, (2) Chemistry and chemical engineering, (3) Mechanical engineering, (4) Biochemical and genetic engineering, and (5) Liberal arts and social science including legal background. This optional course should be assessed as 'PASS' or 'NON-PASS.' If the preliminary test has two courses of intellectual property law and civil law, the points of the courses should be adjusted. As an example, in case that civil law assigns 100 points, intellectual property law will be preferably assigned 300 or 400 points. In the final essay type test, the optional subject should be dropped out form the courses. If the final test has three courses of patent law, trademark law, and civil procedure, the points of the courses should be reassigned. As an example, in case that civil procedure assigns 50 points, patent law will be preferably assigned 200 points and trademark law 100 points. Finally, the questions of the preliminary test and the final test should be qualitatively improved. The questions should be made to test the ability to practice as patent attorney. The questions for question should be avoided.
