Trust of Intellectual Property -Focus on revision of Trust Business Law in Japan-

Recently, when compared with the past, in the aspect of its content, quality, and production dimension, our movie has been greatly improved. But, after reduction of screen quarter, there are much anxiety on whether our movie can keep consistent competitive power. To overcome this situation, for movie production, we should have capital smoothly circulated. And through distribution of produced movie in diverse channels, we should maximize an earning creation from it. For this, we have to examine revision of related law. In the case of Korea, in trust business act, intellectual property rights is subject to trust. But for other laws related to asset flow like funding method, a legislative action is not actively taken. In the case of Japan, through revising a related law and preparing for a value assessment model for introducing banking system to achieve asset flow through trust, a related bank system is performed by national strategy in three-steps. As for Korea, together revising a related law, through establishing value assessment model of intellectual property rights and arranging environment of intellectual property rights, insurance of the second market of movie such as DVD by prohibiting illegal coping and arrangement of market environment should be considered. On the other hand, in the case of a trust management of movie copyrights, a trust management bodies should come to be doubled and to reasonably manage it, a related law on copyrights should be revised from a license system to a registration system.
