A Study on the Improvement Plan of the Collective Management System

A collective management system of copyrights has played an important role in protecting copyright owners' right and facilitating the user's utilization of copyright works. Although a lot of studies have been made on the collective management system until now, there were few literatures which pointed our problems of our copyright laws and suggested its improvement scheme. Taking this account, this studies review the history of collective managements, the foreign legislations, and try to present a legal plan of collective managements. This studies suggest that our copyright law should clarify the requisite of permissions and reduce the kinds of copyright works which can be approved. And because a single collective management system is highly efficient, we should maintain the existing collective management system, but prepare the systematic devices for preventing adverse effects of a single management. Finally By comparing foreign legislations I suggest that our copyright laws make clear the scope in the control of authorities and introduce clauses about mandatory managements, mandatory contracts.
