독일의 기억, 책임 그리고 미래 재단의 설립에 관한 법률을 통한 국가사회주의 시대의 강제노동자에 대한 배상에 대한 검토

Compensation to Former Forced Laborers in the National Socialist Period through the Law on the Creation of a Foundation “Remembrance, Responsibility and Future”

독일은 이전의 국가사회주의시절의 강제노동자들(NS-Zwangsarbeiter)에 대한 재정적 조정에 의한 배상(Wiedergutmachung)을 하기위하여, 2000년에 독일연방의회는 Volker Beck 그리고 Otto Graf Lamsdorf의 주도하에 기억, 책임 그리고 미래 연방재단을 설립하였다. 2000년 8월 2일 독일연방정부 그리고 6,000개가 넘는 독일기업들이 참여한 독일경제계의 재단법인발의가 각각 100억 독일 마르크(D-Mark)의 절반을 제공하여 이전의 국가사회주의-정부 하에서의 강제노동자에 대한 배상을 위하여 기억, 책임 그리고 미래라는 이름으로 권리능력이 있는 공법적 재단법인이 설립된다. 이 재단은 2007년까지 100개국이 넘는 나라들의 천칠백만의 강제노동자들에 대하여 배상을 하였다. 2007년 6월 12일 재단은 공식적으로 보상금의 지급을 종료하였다. 그러나 재단은 또한 계속적으로 화해를 위한 프로젝트에 대한 자금지원을 하고 있다. 이와 관련하여 독일의 국가사회주의-정부하에서의 불법에 과거청산 시도로서 기억, 책임 그리고 미래 재단에 의한 보상에 대하여 살펴보는 것은 일본의 식민지 하에서의 징용노동자 피해보상 문제를 경험한 우리에게 있어서 매우 유용한 작업이 된다. 특히 기억, 책임 그리고 미래 재단법인의 설립에 관한 법률과 재단법인의 정관에 규정된 내용들을 살펴보는 것은 일본과의 전후 배상문제에 대한 법적인 검토와 분석에 있어서 매우 중요한 비교법적인 의미를 가진다고 생각한다. 독일의 ‘기억, 책임 그리고 미래’ 재단법인 설립을 통한 독일국가사회주의 정부시절의 강제노동자들에 대한 배상은 지난날의 잘못된 역사의 전개과정에서 희생된 피해자에 대한 베상이라는 점에서 그 의의를 찾을 수 있다.

The main purpose of Foundation "Remembrance, Responsibility and Future" (Stiftung Erinnerung, Verantwortung und Zukunft(EVZ)), as a German federal organisation being establisched in August 2000 after several years of national and international negotiations is make financial compensation available "to former forced laborers and to those affected by other injustices from the National Socialist period". The capital of DEM 10.1 billion (EUR 5.2 billion) for setting the foundation up in work was given to the foundation in equal amounts by 6,500 German companies to the German Industry Foundation Initiative and the German Federal Government. It is very useful uand helpful for us to study compensation process to former forced laborers and to those affected by other injustices from the National Socialist period through the law on the creation of a foundation “Remembrance, Responsibility and Future” of 2 August 2000, which entered into force on August 12, 2000 (Federal Law Gazette I 1263), last amended by the Law of 1 September 2008, which came into force on 9 September 2008.
