제1기 조규광 헌법재판소장의 판결성향 분석

An Analysis on the Judicial Inclination of Chief Justice Kyu-Kwang Cho in the First Korean Constitutional Court

우리 헌법재판소는 국민들로부터 많은 관심과 사랑을 받으며 입헌주의 실현의 교두보로 자리매김해왔다. 이러한 오늘 날의 헌법재판소가 있기까지 많은 전임 헌법재판관들이 헌법재판소를 거쳐 갔으며, 그 중에서도 특히 1988년 9월에 출범한 제1기 헌법재판소가 우리나라의 헌법재판에 단단한 초석을 놓았다는데 많은 이들이 동의할 것이다. 본 연구는 제1기 헌법재판관 중에서도 특히 헌법재판소장직을 무난히 수행하면서 그야말로 황무지에서 출발한 제1기 헌법재판소를 별무리 없이 이끈 조규광 헌법재판소장의 판결성향을 정성분석과 정량분석을 통해 분석해내는 것을 연구의 목적으로 삼는다. 제1기 조규광 헌법재판소장의 판결성향에 대한 연구야말로 제1기 헌법재판관들의 판결성향 연구에 있어 중요한 비중과 의미를 가지기 때문이다. 이를 위해 본 연구는 조규광 헌법재판소장의 주요 경력과 행적을 제1기 헌법재판소장으로 임명되기 이전과 이후로 나누어 살펴본다. 또한 조규광 헌법재판소장이 제1기 헌법재판소장으로 재직하는 동안 관여했던 주요 사건들 중, 그의 판결성향이 잘 드러나는 대표적 결정들을 정치, 경제, 사회ㆍ문화 분야의 결정으로 나누어 정성적으로 분석하고 평가해본다. 끝으로 조규광 헌법재판소장이 제1기 헌법재판소장으로 재직하는 동안 관여했던 모든 전원재판부 사건들을 대상으로 통계분석을 통한 정량분석도 시도해본다.

This paper aims at analyzing the judicial inclination of the Chief Justice Kyu-Kwang Cho in the First Korean Constitutional Court who led the Korean Constitutional Court for the first six years and placed the Court on a secure footing. The study on the judicial inclination of the Chief Justice Cho will have much importance for the study of the judicial inclination of the First Korean Constitutional Court. To achieve the aim, this paper will examine the life path and the judicial career of the Chief Justice Cho before and after his appointment in the Court. Then, it will qualitatively analyze his opinions as a Chief Justice in the Korean Constitutional Court through the five major cases representing political, economic, social and cultural fields. In addition, this paper will also quantitatively analyze his whole opinions based on the statistics. For these analyses, the analytical frames such as ‘judicial activism v. judicial passivism’ and ‘judicial progressivism v. judicial conservatism’ will be used.
