합의경계 중심의 지적재조사사업 경계설정 개선에 관한 연구

A Study on the Improvement of determinating the Land Boundary of Cadastral Re-survey Project based on Mutual Agreement Boundary

지적종사자의 숙원 사업인 지적재조사 사업이 본격적으로 추진됨에 따라 지적이 가지고 있는 근원적인 문제점을 해결하여 국가의 중요한 공간정보로서의 역할이 기대된다. 본 연구는 사업을 원활하게 추진할 수 있도록 기존의 현실경계 위주의 경계설정 방안에서 소유자 공감을 유도할 수 있는 합의 경계 설정 개선방안을 연구하였다. 합의경계에 따른 경계설정이 효율적이고 합리적으로 이루어지도록 경계설정 프로세스를 정립하였다. 합의의 도출을 위한 조정안을 도입하고 도로중심선과 토지의 정형화를 활용하고 관련 법률과의 검토를 통하여 경계설정이 이루어져야 한다. 합의경계의 과정에서 발생되는 현실경계와의 괴리는 제도적으로 보완하고자 하였다. 결정된 경계는 지상경계화 하도록 하고 경계점표지 등록부를 시스템화하여 해결하고자 하였다. 그리고 합의서의 도입으로 법적인 안정성과 업무처리의 신속성을 확보하고자 하였다.

It have a chance to solve the original problems to have Korean cadastre so as to launch the Cadastral Resurvey Project in earnest and this project will support the increasing industry of spatial information for the country. Thus this study is to focus on the improvement of determination method based on the mutual agreement boundary determination instead of the real ground boundary in order to push forward to this project. Also it is introduced that the process of boundary determination was founded a new method using by the mutual agreement boundary determination. There are necessary of the boundary determination using the special methods a kind of the mutual agreement for delivering the mutual agreement, the practical use of formalizing of land shape, the consideration of relational regulations. The boundary gap between the mutual agreement and real ground boundary is complemented by the cadastral institution. This paper introduces that the decided boundary make to mark the ground monument with the monument book of parcel points. Finally, this determination of the mutual boundary is possible to secure the legal stability and to provide the efficient business process.
