한국 전자감독제도의 재범방지 성과와 실효성 강화방안

A Study on Electronic Monitoring System in South Korea: Results of Recidivism Prevention and Strategy for Enhancing Effectiveness

2008년에 성폭력범죄자를 대상으로 한 전자감독제도 도입 후 미성년자 유괴범, 살인범에 이어 마침내 2014년 6월에는 강도 사범으로 까지 확대실시 되기에 이르렀다. 그 동안 법무부에서는 증가하는 대상자를 관리하기 위한 담당인력을 지속적으로 확보하는 한편, 2013년에는 위험경보에 즉시 대응하기 위한 24시간 '신속대응팀'을 설치ㆍ확대하였고, 2014년에는 경찰과 '전자감독협의회' 구성 등 공조체제를 공고히 하고, 지도감독 강화, 지원프로그램 실시 등 다양한 정책을 시행하였다. 그 결과 제도시행 전에 성폭력범죄에 대한 동종재범률이 14.1%에서 1.5%로 1/9수준으로 떨어졌으며, 특히 2013년에는 전년대비 동종재범률이 2.4%에서 1.72%로 감소되는 성과를 거두었다. 이는 전자장치 자체의 속성에 따른 재범 억제효과에 기인하기도 하겠지만, 그 동안 법무부에서 시행해온 다양한 정책변화가 2013년 재범률감소에 영향을 미쳤다고 볼 수 있다. 이 연구에서는 여러 가지 정책변화 중 어떠한 요인이 재범률 감소에 영향을 미쳤는지를 파악하기 위해, 2008년 이후 성폭력 범죄자 동종재범률 성과를 바탕으로 부착대상자 및 직원을 대상으로 한 국ㆍ내외 선행연구들을 살펴보고, 일선 보호관찰소에서 현장 실무를 직접 담당하는 전담직원들을 상대로 한 설문조사를 통해 재범률감소에 미친 영향을 분석하여 향후 정책 추진에 참고하고자 한다.

Since the electronic monitoring system for sex offenders has been introduced in 2008, it has enforced on kidnappers and murderers. And finally, it had expanded to burglars in June, 2014. The Ministry of Justice has tried to ensure manpower resources and has established 'Quick Response Team' that promptly respond to the risk alarm for 24 hours. In addition, the Ministry of Justice has made the mutual-assistance system strengthen with the police such as establishing the Committee of Electronic Monitoring. Also, other diverse policies are conducted, for example, enhancing monitoring system and operating various programs. As a result, the recidivism rate for sex offender decreased from 14.1% before the electronic monitoring system started to 1.5% after the system started, especially recidivism of the same kind declined by 1.72% last year. These results come from not electronic devices, but also diverse policies implemented by the Ministry of Justice. The purpose of this study is to clarify factors reducing recidivism rate, and to suggest future policies about electronic monitoring. In this study, the author reviewed result of domesticㆍforeign preceding research and surveyed of officials who are in charge of electronic monitoring.
