주요국의 상품 파생상품규제와 국내 규제개선을 위한 시사점

A Study on Regulations for Commodity Derivatives of Major Countries

국내외 상품파생상품 규제는 상품별 구분에 따른 관련 법률체계가 다소 모호한 실정이다. 또한 최근 탄소배출권 등 새로운 종류의 상품파생상품이 거래됨에 따라 관련 규제의 정비가 필요시 되고 있는 시점이다. 최근 미국을 포함한 선진국 금융 감독기관은 금융위기 이후 전반적인 파생상품 시장의 규제를 강화하고 있고, 원유 등 중요 원자재의 투기를 우려하여 상품파생상품 거래와 관련된 규제와 감독도 이전보다 강화하는 정책을 추진하고 있다. 이하에서는 한국을 포함한 주요 선진국의 상품파생상품 규제 현황을 비교하고 이를 통해 중요 자원을 기초자산으로 하는 상품파생상품의 투기를 방지하고, 아직 발달하지 않은 국내 상품파생상품 시장의 발전을 함께 추구할 수 있는 국내 상품파생상품의 바람직한 규제 방향을 제시하였다.

Major countries have enforced regulations about almost derivatives again after financial crisis. However, domestic commodity market is gradually required to use derivatives due to commodity price volatility. Also there is a need to develop more desirable regulations for commodity derivatives. In this study, we compared current regulations of major countries on commodity derivatives. Referring to regulations of commodity derivatives of major developed countries, we hope to find the appropriate regulation direction for commodity derivatives
