1. CONTENTS (1) RESEARCH OBJECTIVES This study aims at finding out proper methods of the rent valuation of the uncompensated roadbed. Also this study aims at criticizing the ruling of the supreme court on the expect ed return rate of the roadbed. (2) RESEARCH METHOD This study was examined concerning present valuation legislation of real estate on the basis of the theory perceived thr[mgh literature survey. (3) RESEARCH FINDINGS This study finds out that basic value is market value and expected return rate is net rent rate. The expected return rate of the uncompensated roadbed should be determined according to the characteristics of the standard land in the neighborhood. 2. RESULTS The ruling of the supreme court on the expected return rate is wrong. However it has restricted validity concerning the uncompensated roadbed.
