유엔해양법협약의 제문제에 관한 연구

A Study on the Legal Issues of the UN Convention on the Law of the Sea

급변하는 새로운 해양질서에 능동적으로 부응하기 위하여 1982년에 채택된 유엔해양법협약이 1994년 이래 발효되어오고 있다. 그러나 동 협약의 여러 규정들은 여전히 그 애매성과 국내법 및 국가관행과의 불일치를 보이며 이는 결국 해양분쟁 및 그 불일치 해결에 있어 어려움을 초래한다. 동 협약상 당사국은 동 협약 개정권고를 유엔사무총장에게 할 수 있는바, 이러한 점을 고려하여 동 협약은 국가관행, 국내법, 특별사정은 물론 동 협약규정 자체 등의 관점에서 검토 및 분석될 필요가 있다. 본고는 직선기선, 만, 무해통항권, 배타적 경제수역에서의 군사활동, 임검권 및 도서제도와 같은 주요 법적 및 현실적 문제점들을 고찰하여 이의 재검토방안을 제시하여 그 해결방안을 권고함은 물론 관련 해양법 규정에 관한 변화의 전번적인 방향까지 제시하고자 한다. 이러한 검토를 통하여 본고는 유엔해양법협약에 대한 균형있고 종합적 인 접근으로 국제공동체 이익은 물론 관련국가의 이익 촉구에도 기여하고자 한다. 본고는 이러한 해양 현실을 감안하여 유엔해양법협약 내용 중 국제사회에서 민감하게 반응하고 있는 일부 주요내용의 문제점을 제시하여 향후 동협약 개정 논의시 등에 참고할 수 있는 기초자료를 제시하고자 한다.

The UN Convention on the Law of the Sea (hereafter “Law of the Sea” or “LOSC”) adopted in 1982 has been effective since 1994. Yet, several provisions of the LOSC exhibit much ambiguity and discrepancies with national laws and state practice, which results in difficulties in settling maritime disagreements and disputes based on the LOSC. According to the LOSC, state parties can make a recommendation to amend the LOSC and request to convene a meeting to discuss the recommended amendment through the UN Secretary-General. In this vein, the LOSC needs to be analyzed and reviewed not only in light of the provisions themselves but also in light of state practices, national legislation, and special circumstances, whether geographical or political. This paper examines only major legal and current issues such as straight baselines, bays, right of innocent passage, military activities in the EEZ, right of visit and regime of islands. And then, the paper will make recommendations on matters that require reexamination, and propose the overall direction for changes concerning relevant LOSC provisions. This paper aims to contribute to furthering the interests of States concerned as well as the interests of the international community.
