소말리아 해적과 국제적 대응방안에 관한 고찰

A Study on the Somali Pirates and International Countermeasures

비전통적 안보위협으로서 해적의 문제는 오늘날 새롭게 생겨난 문제는 아니다. 그럼에도 불구하고 최근 아덴만 및 소말리아 인근 해역에서 발생하는 해적행위는 국제사회의 이목을 집중시키고 있다. 이는 동 지역이 국제적으로 중요한 국제해상교통로이고 이로 인해 많은 국제적 악영향을 미치기 때문이며, 또한 동 지역의 해적행위가 갈수록 조직화ㆍ흉포화ㆍ산업화되어 국제해양안보에 커다란 위협이 되기 때문이다. 이에 대해, 국제사회는 다양한 유형의 방법을 통해 소말리아 해적을 규제하고 있다. 그러나 이러한 노력에도 불구하고 여전히 많은 해적행위가 발생하고 있다. 따라서 이 논문에서는 해적의 국제법적 정의에 대해 살펴보고, 이를 바탕으로 소말리아 해적의 발생현황, 특징, 배경 및 영향 등을 검토하며, 또한 이러한 소말리아 해적의 방지 및 퇴치를 위한 국제적 및 국제법적 대응방안을 분석한다. 이를 바탕으로, 소말리아 해적을 방지 및 퇴치하기 위한 방안의 개선방향을 제시한다.

The International community deeply concerns the piracy in the Gulf of Aden and waters off the coast of Somalia, even though piracy as a non-traditional threat to security is not a new international problem. The reason is that the area is very important international traffic route and that piracy in Somali waters has a bad influence on the international community as a whole. In addition, piracy in Somali waters has become a great threat to the international maritime security as it is organized, brutal and industrialized. There are still many pirates in Somali waters although international society makes an effort to suppress the piracy with multiple measures. Thus, this paper examines the concept of piracy in international law, the current status, feature, background and effect of piracy in Somali waters from the concept and the international countermeasures and responses through international law to prevent and eradicate Somali pirates. With these studies, it suggests ways of improving measures to prevent and eradicate Somali pirates.
