해운법상 내항화물운송사업의 제문제에 대한 소고

A Study on the Problems of the Coastal Cargo Transportation Services in Marine Transport Act

세계 선진경제국들은 지속 성장 가능한 물류체계 형성을 위해 물류와 환경을 조화시킨 환경친화적, 안전 지향적인 수송수단인 연안해운을 재평가하고 국가물류체계에서 그 역할을 증가시키고 있는 실정이며, 우리나라 연안해운도 2009년 기준 연간 약 118백만톤을 수송하고 있는 중요한 운송수단중의 하나이다. 이러한 연안해운의 활성화를 위하여 현행 우리나라 내항화물운송사업과 관련하여 제기되고 있는 각종 민원을 검토하고 입법목적을 달성시키기 위한 방안을 검토할 필요성이 있다. 특히 법 시행의 관점에서 해운법 및 관련 법령이 가지고 있는 문제점의 검토를 통하여 연안해운 발전방향 및 개선방안을 도출해 볼 필요성이 있다. 이에 이 논문에서는 현행 내항화물운송사업의 법제와 관련된 사안에 대한 검토하여 향후 내항화물운송사업의 합리성 확보에 도움이 되고자 한다.

Most developed countries have revaluated the importance of cabotage in terms of the sustainable growth in logistics field with balance of logistics and environment by eco-friendly and safety-oriented system. The importance of cabotage has been increased in Korea and approximately 118 million tons transported in 2009. Since the civil complaints have raised about the current coastal freight transportation, there is a need for reviewing problems related to the marine transportation act and relevant maritime law to invigorate the cabotage. Thus, this study will examine the current law related to coastal cargo transportation business to secure the rationality for the prospective future.
