민간조사제도의 도입에 대한 대학생의 인식에 관한 연구

A Study on the Awareness of College Students to the Introduction of Private Investigation System

세계적으로 민간조사시장은 빠르게 성장하고 있으며, 이미 많은 외국 업체들이 우리나라에서 활동 중이다. 한편 우리나라는 민간조사제도와 관련된 법규의 미비로 인해 국내 업체들의 행위가 불법적인 것으로 간주되고 있으며, 이들 중 일부는 범죄의 온상이 되고 있어 법규의 마련이 시급하다고 볼 수 있다. 그러나 법 정비에 앞서 제도를 둘러싼 여러 가지 문제들에 대한 시민의 인식을 살펴 제도의 올바른 정립 방향을 찾는 것이 선행되어야 할 것이다. 따라서 이 연구에서는 민간조사제도에 관한 이론적 고찰을 바탕으로, 제도의 도입을 둘러싼 관련 문제들에 대한 대학생들의 인식을 살펴보고자 한다. 이들은 예비 사회인으로써 장차 사회에 진출하여 엘리트 집단을 형성하고, 사회의사결정에서 중요한 위치를 차지하게 될 것이기 때문에 그들의 태도를 연구하는 것은 상당한 의미가 있다고 볼 수 있다. 먼저, 민간조사제도의 도입을 둘러싼 주요 논쟁의 핵심인 민간조사원의 업무범위, 자격요인에 대해 탐색한다. 그리고 이로 인해 발생할 수 있는 제(諸) 문제를 고찰하고 이에 대한 대학생들의 인식을 파악한다. 이를 바탕으로 민간조사제도의 바람직한 도입방안에 대한 시사점을 제안하고자 한다.

The employment of private investigators will gradually be prevailing due to several factors such as fear for crimes, a rapid increase of lawsuits, and needs for corporate secret protection or property protection. Specifically, there will be more diverse needs for private investigation service along with the advance in science and technology, an increase of new crimes such as cyber crimes or demand for information security. The global private investigation market has grown rapidly, and a lot of foreign companies already do business in our country. However, the action of private investigators is considered illegal due to lack of law related to a private investigation system in our country, and some firms rather become hotbeds of crime. So the preparation of law is urgently required. The purpose of this study was to examine theories of private investigation system and the awareness of college students about the introduction of a private investigation system. College students are going to work in industries as elite groups who will be one of major decision makers, and it's quite significant to research their attitude. Key issues related to the introduction of a private investigation system were analyzed, which included the work scope of private investigators, their qualification requirements and the selection of a management agency or supervisory office. And what problems might take place in conjunction with it was discussed, and how college students looked at it was analyzed as well. Finally, how this system could work properly in partnership with the police to assist their public peace service was suggested based on the awareness of the college students.
