민간조사 업무범위에 관한 연구

A Study on the Business Scope of Private Investigation

2005년 민간조사 관련 법률안이 국회에 제출한 이후 지난 10여년간 민간조사법 제정 및 민간조사업 합법화에 대한 논의가 계속해서 진행되고 있다. 특히 민간조사의 업무범위에 관해서는 사생활 침해 및 인권침해 가능성에 대하여 법규정의 강화 등이 정비되어야 할 것이다. 최근 들어 개인정보 보호와 관련된 주요 사건들이 발생한 이후로는 ICT(정보통신기술)를 중심으로한 민간조사 업무범위에 관하여도 민간조사업 법률안에서 함께 논의되어야 할 것이다. 이를 위해서는 민간조사업의 업무범위를 명확화하기 위하여 법규정의 강화하고, 벌칙 규정을 강화하여 입법화 단계에서 불필요한 논쟁을 불식시킬 필요가 있다. 또한 개인정보 침해사건이나 ICT 연계 민간조사활동이 지속적으로 증가할 것으로 예상되는 바, 이에 대한 법제도적 보완도 병행되어야 할 것으로 생각된다. 민간조사라는 새로운 직종의 출현과 외국계 민간조사업체의 등장으로 인하여 다른 법률과의 상충관계를 해소하는 방안도 함께 모색되어야 한다. 특히 이러한 노력은 단순히 민간조사의 업무범위와 관련된 사안일 뿐만 아니라, 민간조사의 감독기관에 대한 논의도 연관되어 있기 때문에, 앞으로 후속논의가 필요할 것으로 생각된다.
