장애인차별에 대한 실태와 인권ㆍ복지에 관한 연구

A Study on the Actual State of Discrimination and Human Rights Welfare for the Disabled

본 연구는 장애인의 차별실태를 살펴보고, 그 내용 중 장애인차별금지법상의 주요쟁점과 장애인 인권ㆍ복지를 논하고자 함에 있다. 장애인차별이란 장애인을 주변화시키는 사회적 권력, 문화적 가치 그리고 개인적 편견 등이 결합한 것으로 부정적인 측면에서 장애인을 묘사함으로써 그들을 억압하는 것을 말한다. 차별에는 크게 보면 현행규정 및 실제사례에서 명백하게 특정집단의 구성원이라는 이유만으로 특정인을 배제하거나 특혜를 주는 직접차별과 형식상 공정한 기준을 적용하더라도 정당한 사유 없이 장애를 고려하지 아니한 기준을 적용함으로써 장애인에게 불리한 결과를 초래하는 경우인 간접차별이 있다. 동법에 대한 분석결과, 헌법상 인간의 존엄과 가치를 그 선언적 규정을 위하여 그 하위법인 장애인차별금지법으로 구체적으로 구현하고 있으나, 차별의 개념 내지 범주가 명확하지 않고, 이를 담보하는 구체적인 권리구제장치의 독립성 확보가 미흡한 실정으로 나타났다. 다만 장애인에 대한 인권의식과 관련기구에서 사회통합을 다하기 위한 실천적 노력이 필요할 것이다.

The purpose of this study is to show the key contents of the laws regarding the welfare of the disabled and the alternatives plans in perspective of social integration. People with disability in korea is confronted with types of discrimination in spheres of diverse lives, and the law systems. Prior to 1980s, the law on disabled persons was simply a sympathetic and benevolent purpose only, was also many temporary and declaratory provisions which have no concrete provisions of social right for disabled persons. Disability Discrimination Act in Korea is to declare the rights of disabled people, which define disability widely, discrimination, and give a strong power to the organization and method which relieve the rights of the people with disability. However, the aim of Disability Discrimination Act is to complete social participation and realization of equality with non-disabled persons concerning the level of human rights. Nevertheless, the discrimination against the disabled will be possible if the attitude of general population toward the handicapped is improving.
