The United Nations Convention on the Rights of Persons with Disabilities and the Paradigm Shift of Adult Guardianship -from substituted decision-making to supported decision-making-

This paper is to make clear whether the Korean new Adult Guardianship be consistent with the United Nations Convention on the Rights of Persons with Disabilities faced with the Concluding Observation on the initial report of republic of Korea by UN Committee on the Rights of Persons with Disabilities. In which the Committee provided the recommendation that korean government should approve the Ward's legal capacity including the right to act for himself and change substituted decision-making to supported decision-making. As a result, it became clear that full guardianship type does not agree with Article 12 of the Convention because of a comprehensive authorization for full-guardians and generally limits the legal capacity of ward. The guardian's power to consent to ward's legal act might be consistent with the convention but is not with principle of self-determination and not effective to protect her/him. It is more desirable to apply the contractual guardianship and specific guardianship. Furthermore, the limitation of legal capacity of Ward should be abolished but approved the right of revocation of Disabilities but guardian, exercise of which could be supported by her/him. The concept of Disabilities's right of revocation is inferred from the revocation by reason of mistake in Korean Civil Code. Also to establish Korea's supported decision-making system, we can refer to The Representative Agreement Act by British Columbia in Canada and Supported decision-making model of Victory Law Commision in Australia and The Disability Discrimination Act and The Developmental Disabilities Act in Korea. This study is expected to be helpful in improving Korean adult guardianship system in future.
