Garden and Its characteristics of the architectual copyrighted works

This paper will focus on the legal nature of garden in the viewpoint of copyright law. There has not been much less discussed on the protectible subject matter of garden which is as a kind of the architectural works in view of Korean Copyright Act. There have been no case in Korea. The judgement regarding the protectible subject matter of garden was decided recently in the Japanese Osaka District Court. As for other matters, this case will be helpful for the Korean intellectual property law practices.
