가정폭력ㆍ성폭력피해자 지원 강화를 위한 전략과제 개발

Ⅰ. 서론 1. 연구의 필요성 및 목적 □ 연구의 필요성 최근 여성과 아동에 대한 성폭력 및 가정폭력을 인권에 대한 침해로 이해하고 이에 대한 예방 및 대응책을 요구하는 국민인식이 제고되고 있다. 이에 따라 성폭력 및 가정폭력 방지 차원에서 피해자 보호 및 가해자 처벌강화와 관련된 법개정과 제도 도입이 이루어지고 있다. 피해자 보호 및 가해자 처벌 강화를 위해 최근 도입된 법과 제도를 살펴보면 다음과 같다. 성폭력 사건의 경우 2차 피해를 야기하는 요인으로 지적된 친고죄가 2013년 6월부터 폐지되고, 강간의 객체가 부녀자에서 사람으로 확대되고, 유사강간죄가 신설되고, 공소시효가 적용되지 않는 성폭력 범죄의 범위가 확산되고, 국선변호사 지원 서비스가 전체 성범죄피해자에게 제공되고, 13세 미만 아동ㆍ청소년이나 장애인 피해자를 위한 진술조력인 제도가 도입되었다. 가정폭력 사건의 경우 접수된 가정폭력 사건에 대한 경찰출동이 의무화되고, 가해자에 대한 경찰 현장진입이나 조사를 거부하거나 접근금지 명령을 이행하지 않을 경우 500만원 이하 과태료를 부과하고, 가정폭력 가해자를 현행범으로 체포하고, 상습법이나 흉기 이용자는 구속 수사하도록 하고 있다. 이와 같은 정책적 환경 변화와 성폭력과 가정폭력 관련 의제에 대한 정부정책의 우선순위를 고려할 때 국정과제의 효과성을 증진하기 위한 구체적 실천전략을 개발할 필요가 있다.

More than 20 years have passed since legislative acts on the prevention of sexual assault/domestic violence and protection, etc. of victims thereof were enacted in Korea. And the institutional environment and support services for those victims have improved steadily with increased government funding during the past two decades. Ensuring a safe society from sexual violence and domestic violence is part of the national agenda under the Park Geun-hye government, following her pledges to eliminate "Four Major Social Evils" - sexual violence, domestic violence, school violence and unsafe food. New laws and institutions have recently been designed to improve the protection of sexual assault/domestic violence victims as well as punishment of and measures against the offenders. When it comes to prioritizing the government's policies with regard to the sexual assault/domestic violence issues, concrete strategies and action plans need to be developed to maximize the effect of implementing the national agenda in this area. Moreover, by reviewing the key issues in the current laws and institutions pertaining to the prevention of sexual assault/domestic violence, policy tasks need to be developed to promote policy implementation. In this study, the following themes were identified as the key policy areas for the prevention of sexual assault/domestic violence and the protection of the victims; strengthening the protection and support for the victims of sex crimes following the amendment to the Criminal Act by deleting the provisions which require victim's complaint for public prosecution; improving the expertise in dealing with domestic violence cases and promoting the human rights of the victims; better protecting children/ juveniles from sexual abuse; enhancing education for sexual assault/ harassment prevention, and; improving the operations of comprehensive sexual assault victim support centers to provide more effective support for the victims. The latest trends in the policy areas were examined through the "KWDI Forum on the Development of Strategies for Implementing the National Agenda of Domestic Violence/Sexual Assault Prevention," which held four times. And based on the review of related policy tasks, strategies and action plans were developed to promote policy implementation.
