Libertarian Approach to Anti-corruption

국제투명성 기구의 2004년도 공공부문 부패지수에 의하면, 한국은 146개국 중 47위를 기록했다. 부패지수가 처음 산출된 1995년 이래 각종 부패근절 노력에도 불구하고 부패지수는 별반 개선되지 못하고 있다. 이는 법적 처벌기구 내지 통제기구를 통한 부패 억지에는 일정한 한계가 있음을 보여준 것이다. 이 글은 우리 사회에 만연된 부정과 부패는 시장경제 때문이 아니라 오히려 시장경제체제가 억압되었기 때문이라는 인식에서 출발하고 있다. 이같은 인식에 기초해, 반反부패에 대한 시장경제체제의 함의를 '자유주의' 시각에서 조명하고자 한다. 자유주의 시각에 기초한 이 글의 주장은 명료하다. 부패는 공정한 게임의 규칙을 파괴하고 열린사회를 닫히게 하는 '반문명적 행위'이며, 부패가 억지되지 않는 한 부패경쟁은 부패균형을 낳고 부패균형은 부富를 파괴시키는 축소균형을 초래한다. 그러나 시장경제체제가 정착되면 개인의 선택을 제한하는 자의적 '제약과 규제'가 최소화돼, 이를 편법으로 면하려는 '부패의 여지'가 그만큼 줄어 부패수준이 낮아진다. 따라서 인적청산과 징벌 중심의 부패억지가 아닌 '법치적, 시장친화적, 사유재산 강화적, 반패거리적, 개방적'정책과 철학에 토대를 둔 긴 호흡의 자유주의 접근을 통해서만 부패를 효과적으로 억지할 수 있다. 이는 자유주의에 기초한 시장경제질서의 구축을 의미한다. 경제자유를 누리는 국가, 시장경제체제가 온전하게 정착된 국가의 부패수준이 낮은 것은 결코 우연이 아니다.

According to the TI Corruption Perception Index 2004, Koreahas been ranked 47th position out of 146 countries. Since 1995the launching year of CPI release the scores of CPI has not beenimproved in Korea. It implies that the anti-corruption policymeasure centered on penalty and punishment codes has its ownlimits in alleviating corruption. This paper has a recognition thatthe corruption and bribery has not been rooted on the marketeconomy but has been resulted from suppressing the marketeconomy. The purpose of this paper is to draw some implicationsof Libertarian approach against the corruption. The implications of the paper are rather straightforward.Corruption is a daunting obstacle to sustainable development androbs country of its potential, which leads to the disruption ofwealth. But the market economy will cover up the loopholes forcorruption by minimizing the discretionary regulation andrestrictions imposed on economic activity. Hence the reinforcingthe market principles such as rule of law, the property rights,anti-cronism, market friendly regulation could be effectivemeasures. The negative relationship between economic freedomand the corruption has its own rationale.
