해외 한국인 납치테러 사건의 실태와 대응방안

The status of overseas kidnapping terror on Koreans and a countermeasure for it

최근 해외 우리 국민들이 납치테러의 주요 대상으로 떠오르고 있음에도 불구하고 정부 당국은 적절한 대안을 제시하지 못하고 있다. 따라서 이 연구에서는 한국인을 대상으로 하는 해외 납치테러 사건의 목적과 유형, 증가하고 있는 다양한 위협요인과 피해발생 실태를 분석하고, 이를 통해 향후 해외 한국인들의 납치테러 피해를 예방하고 사건 발생시 효과적으로 대응할 수 있는 정책적 방안을 모색하였다. 연구결과, 해외 한국인 납치테러 피해를 억제하기 위해서는 첫째, 현재 국회에 장기간 계류 중인 관련 법률의 조속한 제정을 통해 납치테러 사건에 신속하게 대응할 수 있는 법률적 토대 구축해야 할 것이다. 둘째, 정부 당국의 대응역량을 향상시키기 위해 먼저 외교부는 국제 공조협력체계를 강화하고, 외교부 내에 인질협상과 형사사법 분야의 전문 인력을 양성, 파견하며, 해외여행 안전매뉴얼의 재수립과 홍보활동 확대, 경찰청과의 협조를 통한 위험국가로의 경찰공무원 파견 증대 등을 시행해야 할 것이다. 또한 문화체육관광부 등 관광 당국에서는 외교부와의 협조를 통해 신속한 여행경보 안내 시스템을 제공하고, 납치테러 발생시의 안전매뉴얼을 적극적으로 홍보해야 할 것이다. 셋째, 최근 증가하고 있는 한국인 탑승 선박에 대한 납치테러를 억제하기 위해 한국선박을 보호할 수 있는 파견 구축함을 증가시킬 필요가 있고, 국제 공조 강화는 물론 국내법적 기준 강화를 통해 최적항행수칙(BMP)의 준수 의무를 이행하도록 강제해야 할 것이다. 넷째, 정부뿐만 아니라 민간 기업에서도 납치테러 등의 위기 상황에 대한 대처요령 및 방법 등이 포함된 단계별 세부 지침과 대응 시스템을 마련하여 유사시 효과적으로 대응할 수 있는 토대를 구축해야 할 것이다.

Though Korean citizens became the objects of kidnapping terror in overseas, government is not able to present a proper countermeasure against it. The purpose of this study is analyzing the purpose, type, various intimidating causes and damage occurrence status of the overseas kidnapping terror on Koreans and suggesting a political plan, which can prevent the overseas kidnapping terror on Koreans and minimize the damage of it by active action against it. The result of the study is as following. First, a foundation for legal response, which would enable quick response on overseas kidnapping terror on Koreans, should be built as early as possible by earlier legislation of related laws which are pending in the National Assembly for a long time. Second, in order to enhance the response ability of government, Ministry of Foreign Affairs should set up a plan on the reinforcement of international cooperation system, cooperation in criminal judicature, fostering and overseas-dispatching of specialists who can take charge of cooperation and hostage negotiation, reestablishment of overseas travel safety manual and expansion of PR of it and increase of the police officers dispatch to the risky countries by cooperating with National Police Agency. In addition, the agencies related to tourism including the Ministry of Culture, Sports and Tourism should provide with earlier travel warning and actively publicize the safety manual when a Korean would suffer a criminal damage including kidnapping terror. Third, to restrict the recently increasing kidnapping terror on the vessels with Koreans onboard, it is necessary to increase the number of dispatched destroyers, which can protect the vessels with Koreans onboard. Further, the vessels should be forced to abide by BMP (best management practice) by reinforcing the related domestic legal standard. Fourth, both government and private companies should build a foundation for an effective response by preparing stepwise detail guideline and response system including the response tips and methods against crises including kidnapping terror.
