살인범죄는 고의를 갖고 타인을 살해한 위법행위라고 간략히 정의한다. 살인범죄는 그 피해를 전혀 복구할 수 없고 범죄에 대한 두려움 확산이 가장 큰 범죄유형이라고 할 수 있다. 또한 형벌에 의한 일반예방효과가 미미한 우발범이 많기 때문에 사전예방이 더욱 중요하다고 볼 수 있다. 이러한 전제에서 본 논문에서는 살인범죄의 원인 경향, 발생분포 등을 다각도로 분석하여 그 예방책을 마련하고자 한다. 따라서 본 논문의 목적은 살인범죄의 원인을 분석하고 그 대응방안을 도출하는데 있으며, 분석범위는 1996년부터 2000년까지의 5년을 삼았다. 결론적으로 살인범죄의 예방은 잠재된 가해자와 피해자의 성향에 대한 대책이라고 할 것인데, 가해자에 대한 처우와 함께 살인범죄에 노출되기 쉬운 피해자의 성향, 행태를 제거하는 것이라고 할 수 있다.
Murder can be defined as the common law as the unlawful killings of a human being with malice aforethought. In this thesis I analyzed Cause, trends, distributions of murder in Korea and prevention policies of murder. The purpose of this study is to identify the definition of murder, to analyze the cause of murder, and to present preventions for the murder crime. The range of this study is the murder which are commited in Korea from 1996 to 2000. In conclusion, the prevention of murder crime is depend on the policy to latent murder. It is important that the treats to those who have a latent murder and the elimination of the symptoms of murder behavior, and the characteristics of the murder victims.
