민영교도소 경비시스템에 관한 연구

Examining the Security System of Private Prisons

미국의 최근 연구결과나 본 연구자가 이번 여름 텍사스교도소를 방문조사한 결과에서도 주정부의 공공교도소와 비교활 때, 민영교도소 교도판의 불만이 더 적고, 관리가 좀 더 유언하였으며, 권한이 더 많이 위임되며, 업무만족도도 더 높았다는 결과를 얻어내었다. 우리나라에서도 지난 1999년 12월 28일에 행형법을 개정하여 교도소 등 설치ㆍ운영에 관한 민간위탁에 관한 법률 제정ㆍ공포되었다. 이러한 행형법의 개정에 의하여 2000년 1월 28월에 민영교도소 등의 설치ㆍ운영에 관한 법률이 제정되었다. 본 연구는 민영교도소에 대한 체계적이고 이론적인 접근들 통하여 새롭게 도입될 민영교도소의 민간경비시스템 활용방안을 중심으로 첫째, 운영기술개발 및 선진경영기술의 도입방안, 둘째, 수용자 처우개선방안, 셋째, 첨단기계시스템을 통한 운영의 선진화 방안 등에 관하여 논의하고자 한다.

As Comparing the state prisons with the private prisons in the basis of recent research outcomes and my experiences which visited and grasped the atmosphere in Texas prison this summer, It makes conclusion that the private prison officers has less complained, more reflexed and delegated the power, and pleased their work than the state prisons. After being reformed the execution law in December 28, 1999, it is enacted and proclaimed the law on the committment to civil establishing and operating the prision in Korea. By this reformation, it is enacted a law on establishing and operating the private prisons in January 28, 2000. I try to examine the practical plans of the private security system for the private prisons as follows; first, a development of operational tactic and introduction plans of the advanced managerial tactics, second, a plans to improve treatment for inmates, third, a plans to be advanced the operations through the newest instrumental system.
