보험사기의 가해적 특성과 제재 효율성에 관한 연구

A Study on Offender Characteristics Insurance Fraud and Punishment Efficiency

우리나라는 보험시장의 규모가 세계 7위로 보험이 일반화되어 있다. 그러나 보험제도를 악용하여 금전적 이익을 취하는 경우가 점차 대중화되어 가고 있으며 그 규모 및 수법 역시 지능화 되어 가고 있다. 이러한 점에서 살펴볼 때 현재 우리나라의 경우는 민간 그리고 민ㆍ관간의 공조를 위한 시스템의 정착이 필요하고, 보험사기의 확산속도나 경제에 미치는 영향에 비해 이에 대한 연구 및 조사활동이 미비하며, 보험사기에 대한 대책은 이미 발생된 범죄 및 보험금 청구와 관련해 사후 수사 등 발생후 대책에 머물러 있어서 실제 보험사기를 예방하기에는 부족하다는 점 등을 제시하면서, 보험사기를 단독으로 또는 형법상의 사기로 의율할 수 있는 방안, 그리고 가장 중요한 것은, 보험사기의 특성상 그 범죄사실이 눈에 즉각적으로 드러나지 않기 때문에 각 보험사가 보유하고 있는 데이터를 미국의 ISO(Insurance Service Office)경우처럼 3자적인 입장의 중립적인 기관을 설립, 통합 집중 관리하여 의심이 가는 사안에 대하여 수사기관에서 수사시 조회ㆍ공유할 수 있도록 함으로써 수사의 효율성을 높이는 등의 종합적이 대책이 필요하다는 점 등을 강조하였다.

Lately, in Korea the insurance fraud is on the increase and the criminal act becomes more and more various, advanced, intellectual, systematic and violent. In spite of that situation, the Korean insurance companies are faced with a serious problem because they are unable to cope with the insurance fraud efficiency and systematically. To recognize insurance fraud, I used financial supervisory service's secondary data which is related to insurance fraud. In korea, characteristics of insurance fraud can be listed as follows : Firstly, insurance fraud is rapidly increasing to compare with the past. Secondly, insurance frauds which is related to traffic accident are much more rather than other insurance fraud types. Thirdly, insurance frauder is largely composed of the age of 20-30, because of unemployment caused to depression. Fourthly, the rate of insurance frauder into criminal justice process is very small. In order to prevent such insurance fraud, We must take all the efforts such as insurance company's countermeasure, the collaborative action of insurance circles, the government's legal and institutional guidance and support, enforcement of education which is related to insurance fraud. Also, We have to interest cooperation both insurance company and investigation systems like police.
