최근 소년사법의 경향에 따른 소년범에 대한 효과적인 대응방안의 모색

Searching for an effective plan on juvenile offender in related to the trend of the recent juvenile justice system

오늘날 소년범죄의 심각성은 양적인 측면에서 보다 내용적인 측면에서 보다 문제가 되고 있고, 더구나 소년범의 높은 재범율은 지금까지 소년사법에서 수행된 정책들에 회의를 주고있다. 따라서 이러한 문제에 대한 보다 획기적이고 효과적인 대책방안을 마련해야 할 필요가 있다. 그 구체적인 방안으로 현재 경찰은 소년범에 대한 경찰의 다이버전 제도를 도입하려 하고 있는데, 이는 소년범의 경우 소년사법목표에 비추어 볼 때 성인범과 달리 처벌의 대상이라기보다는 보호받아야할 대상이므로 공식적인 형사제재에서 비롯되는 낙인의 가능성을 최소화함으로써 소년들이 상습적인 범죄자가 될 위험성을 줄일 수 있다는 점에서 바람직한 제도라 본다. 따라서 경찰단계에서 소년범 다이버전의 도입은 실현되어야 하며, 그 구체적인 방안으로 최근의 소년사법의 동향인 균형적 사법이나 회복적 사법, 점진적인 제재 모델 등의 적용 가능성을 고려하여 볼 수 있는데, 이러한 모델의 적용을 통한 프로그램의 개발은 범죄의 당사자인 피해자와 가해자 뿐 아니라 지역사회 모두의 참여를 통하여 재범을 억제하고 지역사회를 보호할 수 있다는 점에서 소년사법의 문제를 해결할 수 있는 근본적이고 종합적인 대책이라 여겨진다.

younRecently juvenile delinquency is getting more serious. Specially the most serious problem of them is that they commit crimes repeatedly after being released from prison. Therefore we are obliged to prepare for counterplans to solve these problems. Juveniles who violate the law should be treated differently from adults in point of the purpose of juvenile justice. Labeling theorists suggested 3D-policy. Diversion is the term applied to various ways to divert offenders from the formal criminal justice system. A range of diversionary options exist for young offenders in developed countries but there are not much diversion program in Korea. Moreover police-based diversion system is not admitted in Korea. So, police-based diversion system should be introduced and policy makers have to search for various programs. In this point we should review finding and assess the implication for current policymaking and further research on diversion programs and activities in another countries. This study will show efforts of our state to introduce police-based diversion and assess the success of diversion activities in another countries. Finally this literature will search for a plan to introduce the polive-based diversion on the juvenile justice system and specially this plan will focus on restorative justice.
