민간경비 규제에 관한 연구

A Study on the Regulation of Private Security in the U. S. A.

국내 민간경비는 최근 20여 년간 고속성장을 거듭하면서 여러 문제점과 부작용을 낳고 있다. 우선 경비원의 낮은 질적 수준으로 인한 경비원의 절도, 폭행 등 범죄문제를 비롯해, CCTV 설치 등으로 인한 프라이버시권 침해 문제, 경제력이 있는 개인과 집단에게만 혜택이 부여되는 형평성의 문제, 총기 등 물리적 강제력의 사용에 따르는 정통성의 문제 등 다양한 문제점을 노출시키고 있다. 이와 같이 민간경비가 급성장하고 문제점이 늘어나면서 민간경비에 대한 규제, 특히 정부 규제에 대한 요구의 목소리가 높고, 규제의 강도 또한 높아지는 실정이다. 하지만, 과연 정부 규제를 어떤 방법에 의해, 어느 정도까지 허용할 것인가에 대해서는 논란의 여지가 많다. 특히 우리나라의 경우, 민간경비의 급성장에 따른 각종 문제점과 후유증이 최근 급증하면서 규제의 방향설정과 문제해결이 시급한 형편이다. 그러나 아직까지 민간경비 규제에 대한 정책적 논의는 물론 학문적 논의 역시 거의 전무한 실정이다. 따라서 본 연구는 미국의 민간경비에 대한 규제를 연구함으로써, 국내 민간경비에 대한 규제논의를 이끄는 한편 규제 방향성을 검토하고자 한다. 미국은 세계최초로 민간경비를 산업화한 국가이며, 지금도 세계 민간경비 시장의 30%이상을 차지하고 있다. 민간경비에 대한 규제 역시 국내처럼 철저하게 법적ㆍ행정적 규제 위주로 시행되고 있는 것이 아니라 자율규제, 시장기능에 의한 규제, 소송에 의한 규제, 협의체 구성에 의한 규제 등 다양한 규제방법을 사용하고 있다. 그러므로 미국의 다원화되고 다양한 규제 방식과 특성, 그리고 이러한 규제를 낳은 요인들에 대한 검토와 분석은 향후 국내 민간경비 규제 논의와 연구에 있어서 매우 필요한 부분이 아닐 수 없다.

The regulation of private security has recently become more important because of its rapid growth. The rapid growth of private security has produced a number of problems. These include concerns over the quality of persons working in the industry, poor standards of operations, and anxiety over the level of responsibility. The industry has been said to be vulnerable to misconduct and to the covering up of misconduct. In addition, the problems of privacy, inequality and legitimacy should not be underestimated. For these reasons, the employees in the private security industry and the operations of firms should be scrutinized and regulated. It is difficult to expect substantial development of private security industry without strict guidance, supervision, and cooperative effort. Since private security companies are responsible for people's lives and assets, it seems clear that the companies should be under the strict regulation. Thus, various mechanisms for the regulation of private security, including governmental guidance, self-regulation, market forces, and civil suits, are created to regulate the private security. However, there have been very few studies focusing upon the regulation of private security in South Korea. The purpose of this study is, therefore, to examine the issues concerning the regulation of private security industry in the United States, which would contribute to bring new academic and policy interest in South Korea.
