소방 특별사법경찰의 역할 제고 방안

A Study on Methods to Improve the Role of Special Judicial Police for Fire Service

소방기관은 현대 사회 이전에는 화재진압을 주로 하는 기관으로 알려지고 있었으나 오늘날에는 화재에 대한 예방과 진압뿐만 아니라 재난이나 재해에 대응하고 이와 관련된 위급한 상황에서의 구조와 구급업무까지 수행하면서 국민의 안전과 생명을 지키는 기관으로 인식되고 있다. 경찰은 직접적인 목적에 따라 행정경찰과 사법경찰로 분류할 수 있으며, 범죄수사를 전담하는 사법경찰은 다시 일반사법경찰과 특별사법경찰로 구분할 수 있다. 소방기관에서도 범죄수사와 관련하여 특별사법경찰업무를 담당하고 있는데, 「소방기본법」을 비롯한 소방관련법 위반범죄에 대하여 특별사법경찰의 업무를 수행할 수 있도록 규정되어 있다. 하지만 화재의 현장과 출동하여 접하고 화재 조사를 하는 빈도가 가장 많은 소방기관이 화재와 관련한 수사에 대해서는 접근할 수 있는 권한이 부여되어 있지 않은 상황은 문제점으로 지적할 수 있을 것이다. 이와 관련하여 관련 법률규정을 검토하고 실제로 담당하고 있는 업무를 분석하였으며, 몇 가지 사례를 토대로 소방 특별사법경찰의 효율성을 제고할 수 있는 방안을 모색해 보았다. 소방 특별사법경찰의 역할에 대해서는 「소방기본법」 등 소방관련법을 위반한 경우에 사법처리를 하기보다는 과태료 부과를 하는 경우가 많았고, 특별사법경찰 제도를 사법적인 목적의 달성보다는 행정적 목적 달성을 위한 실효성 확보수단에서 활용되고 있는 것으로 분석할 수 있었다. 발생하는 화재사건의 약 3% 미만이 방화사건으로 나타났는데, 방화사건에 대해서는 전적으로 경찰이 수사를 담당하고 있다. 그러나 많은 화재사건을 담당하고 있는 소방이 화재사건의 수사를 담당하는 것이 전문성을 고려한 특별사법경찰제도를 운영하는 취지와 맞는 것으로 볼 여지가 있다. 이에 따라 소방특별사법경찰의 역할을 증대시키고, 방화범의 수사에 소방기관이 관여하는 방안을 제시하였다.

Fire service had been known to suppress fire before modern society, lately it has been recognized to protect safety and life of people while rescue and relief in the emergency conditions and not only prevention and suppression of fire but also calamity and disaster. Police is divided administrative police and judicial police as directly purpose, and judicial police in charge criminal investigation is divided general judicial police and special judicial police. Fire service administer special judicial police against violation by relation to fire such as fire common law, the law of fire institution establishment maintenance and safety management, the law of fire institution construction business, and the law of safety management for dangerous article. Fire service go start to fire spot and accomplish fire investigation the most frequently, but fire service cannot investigate arson because they have not possess the right of investigation for arson or accidental fire. Thus, the law related fire service and the reality of the works of charge is analysed. The case is researched and is taken the methods to improve the role of special judicial police for fire service. Fire special judicial police impose a fine for default more than judicial disposal in the case violation against fire common law and so on. This system utilize to accomplish administrative purpose as means to guarantee practical effect more than to accomplish judicial purpose. Below about 3% of all happening fire is arson, these case police investigate on the whole, but it is rational that fire service in charge of all fire accidents should assign to investigate of arsonist. Special judicial police system is manage to consider the specialty of administrative affairs. The plan to improve will present the role of fire special judicial police should increase and fire service should investigate arsonist and the person of accidental fire because of large experience for fire accidents.
