The Need for Improving Background Investigations into Security Personnel

현대의 민간경비는 과거 공동체 구성원들이 공동체의 질서를 유지하고 스스로의 안전을 지키고자했던 원시적인 자위방범 형태에서 현재는 수많은 인력과 전문가들이 종사하고 최첨단 시스템과 전자장비를 갖춘 복합적이고 현대적인 산업으로 성장했다. 민간경비의 근간이 되는 경비인력은 치안서비스의 공적인 공급주체인 경찰공무원과 함께 개인의 생명과 재산을 보호하고 범죄를 예방하며 국민의 안전욕구를 충족시켜 주는 업무를 수행하고 있다. 이러한 사회적 변화에 발맞추어 능력과 자질을 겸비한 경비인력을 채용하고자 하는 기업의 수요와 사회적 요구 또한 증가하고 있다. 그러나 경비인력 채용과정의 실제를 들여다보면, 가장 기본적이라고 할 수 있는 경비인력의 경력조사 단계에서부터 심각한 문제점을 드러내고 있다. 이 연구에서는 그 동안 경비인력의 채용과정에서 결격사유를 제대로 확인하지 못해 일어난 우리나라의 사례를 되짚어 보고, 그에 대한 개선방안으로 첫째, 경력조사 범위의 확대, 둘째, 경력조사의 의무화와 수시화, 셋째, 경력조사기관의 범위 확대 등을 논의하였다.

Since the beginning of recorded time, people have sought security. Now security industrial is much more important to the business itself. But arguments in civil liability cases involving security may be based on one of several legal theories but generally involve either a claim of inadequate security or one of negligent hiring and retention. In order to lead and manage an effective organization, employers in private security need to know the essential information about their employees, or security personnel that might impact their job performance both permanently and temporary. The process of acquiring information on and individual through third-party services, government organizations, and private individuals in the hope of making a determination on the future actions of an individual based on past actions. While the information can include potentially anything about the individual's employment, credit, or past history, the most common usage refers to criminal history records checks. This study takes focus on the improvement of legal basis and the change of methods in background investigations of security personnel. So this study recommends 1) the expansion of scope in background investigations, 2) the shift to compulsory and random background investigations, and 3) the enlargement of background investigation agencies including police stations and provincial police headquarters which located in other jurisdictions.
