한국 범죄학의 학문적 성격과 발전방향

The Characteristic and Prospect of the Korean Criminology

범죄는 그 사회의 법률에 따라 정의되는 것이 일반적이다. 그 사회와 구성원을 통해 범죄의 원인을 발견하므로 사회의 병리현상으로 이해하기도 한다. 또한 범죄 또는 범죄자에 대해 법학, 사회학, 심리학, 의학(생물학), 통계학 등에 이르기까지 다양한 분야의 지식을 통해 과학적으로 연구하는 학문을 범죄학이라고 정의한다. 범죄학은 역사와 발전과정에 따라 종합과학적 성격의 학문적 정체성을 확립해왔다. 그러나 한국 범죄학은 급속한 발전에도 불구하고 이러한 다양성으로 인해 학문의 분류체계에 있어 여전히 독자적 학문으로 정립되지 못한 상태이다. 이 연구는 범죄학의 역사와 발전과정을 토대로 한국 범죄학의 성격과 범위에 대하여 재조명해 보고자 하였다. 과거 다수의 연구들에서 학과(또는 교과목) 및 학회의 취지, 학문의 분류체계에서 범죄학 분야를 구분해 보면, 다학제적 영역을 포괄하고 있는 것으로 나타났다. 또한 국외에서 발전된 다양한 이론들이 이미 우리 실정에 맞는 과학적 검증이 이루어지면서, 독자적 학문으로 정립된 것도 사실이다. 즉, 범죄학은 개인 및 사회에 대한 다각적인 연구를 통해 우리사회의 실정에 맞는 적합한 대책을 수립하는 것을 궁극적인 목적으로 하고 있다. 이를 위해서는 한국의 실정에 맞는 범죄학적 이론이나 증명방법들이 개발되어야 할 것이다. 우선적으로는 범죄 또는 범죄학의 개념에 대한 체계적 정의가 필요해 보인다. 또한 관련 연구소의 설립을 비롯하여 관련 학과와 학위, 교과목의 재정립을 위해 학문분류체계의 개선을 모색할 필요가 있다. 나아가 향후 한국 범죄학이 학문의 분화과정을 통해 독자적 학문으로 정립될 것을 기대해 본다. 이 연구는 다양한 이론과 연구의 발전을 위해 후속 연구들의 토대연구로 범죄학의 성격과 범위를 재조명하는데 의의를 둔다.

Generally crime has been regarded as a phenomenon of social pathology which is subject to the society's legislation. For this reason, roughly, causes of crime could be founded in the society and people. In this respect, Criminology is to scientifically scrutinize crimes as well as criminals. Criminology is a vast interdisciplinary field that draws upon research in law, sociology, psychology, biology and statistics. Due to the feature of Criminology there is still an argument over whether it could be defined as an independent discipline or not. Many studies have been conducted on the academic identity of Criminology. Despite the fact that Korea witnesses the radical development in Criminology, there are very few researches on what characteristics criminology has and to what its scope is academically limited. Therefore, this study covers the status of Korean's Criminology, with reviewing history and developmental process of the discipline. The result indicates Korean's Criminology seems to embrace an interdisciplinary area, especially in light of previous research literature, the purpose of establishment of the Criminology departments or academic associations, and disciplinary classification. In addition, applicable scientific methods and theories into Criminology itself have already been proven empirically in Korea. Therefore, it could be argued that, in a broad sense, Criminology is recognized as an independent discipline featuring in a comprehensive science. The next work to be solved should be the process in dividing Korean's Criminology into specialities. In order to do it, most of all, it is necessary to reach the consent over concepts of crime and Criminology. After then, these are demanded; legal revision of discipline classification system, rearrangement of degree, majors and subjects associated with Criminology and institutions of Criminology.
