국제범죄환경의 변화에 따른 보안ㆍ수사기관의 대응능력 제고방안

Amelioration of SecurityㆍInvestigative Agency to coping with the Change of Transnational Criminal Environment

오늘날 세계화 현상이 가속화 되면서 범행 할 수 있는 공간이 확대되는 등 국제범죄 환경이 크게 변화하고 있어, 이에 대처하는 보안 및 수사기관들의 대응능력 개선이 긴요한 실정이다. 이와관련, 국제범죄 환경의 변화와 이에 대응하는 보안수사기관의 체제를 분석한 결과, 국가 사이 또는 국내 대응기관간 협조체제의 강화 필요성과 일반범죄의 국제화 현상 심화, 대응기관들의 적극적인 정보활동이 긴요하였으며, 끝으로 한국이 중국의 흑사회 등 국제범죄조직의 좋은 타깃이 될 것으로 평가되었다. 이러한 평가를 토대로 대응하는 기관간 공조 및 각 기관들의 정보활동 강화방안을 중심으로 보안수사기관의 대처능력 제고방안을 제시하였다. 전자는 국내차원에서 각종 국제범죄 대응 협의체 운영형태의 개선, 대응기관간 협력채널 활성화, 통합 국제범죄대응 실무기구를 설치하며, 국제적 차원에서는 형사사법공조 조약 체결국가 및 그 공조범위의 확충, 대응기관간 네트워크 구축 확대, 각종 국제경찰기구와의 협력 활성화, 동아태지역 국제범죄 방지기구 설립 등을 제안하였다. 후자의 구체적 방안으로는 범죄정보 수집단계에서 대상목표에 대한 철저한 분석, 첩보원 심층 부식, 휴대폰 감청 및 제3자 거래 기록 수집을 위한 제도적 뒷받침 마련 등을 제시하였다. 그리고 정보분석 및 배포단계에서는 전문 범죄정보 분석관 운용 및 완성된 정보의 신속하고 안전한 전달을 위한 배포장치 마련 등의 방안을 제의하였다.

Nowadays, transnational criminal environment is changing enormously by a rapid progress of globalization. Therefore, security agency and investigative agency are offered some strong effective actions to the changing. Analyzing the system of the security agency and investigative agency to the phenomena, the writer estimated as follow; Need for a closer cooperative systems between the related organizations in domestic, and between the countries, getting more transnationalization of general crime, strengthening of the intelligence activity of the agencies, and being attractive target to Korea by transnational criminal organizations like 'HukSaHoei, gand violent group in China'. The writer suggested plans to bolster the agencies focusing on mutual aid and intelligence activity. The former, at our country level, He suggests improving the management type of consultative committees for transnational crimes control, vitalizing the cooperating channels between the confrontation organizations against the crimes, and Establishment of 'integrated counter-transnational crimes organization' in working level. At the international dimension, proposed expansion of concluding Treaty on Mutual Legal Assistance in Criminal Matter and the cooperation range, making more network construction between confrontation organizations, vitalizing the cooperation with various international criminal police organizations, founding 'international crime preventing organization' in East Asia and the Pacific area. The latter one is to have thorough analysis to targets on the stage of crime information gathering, to implant intelligence agent in the crime group deeply, to make law or rule support for cell phone interception and collecting record for the third party transaction. Futhermore, The writer offers operation of specialized analyst for crime information, and preparation of distribution devices to delivery completed intelligence fast and safely.
