한국의 자치경찰제 모형설정에 관한 연구

A Study on the Development of Decentralized Model in Korea

지방자치란 의사결정의 자유와 행위의 자유를 본질적 사상으로하여 ‘지방의 일’을 ‘스스로 결정’하고 처리한다는 것을 의미한다. 지방의 일이란 다양한 개인적 문제로부터 지역의 공동문제, 지역의 행정, 치안 및 복지 등을 말하고, 스스로 결정한다는 것은 자신의 일을 다른 기관으로부터 제약을 받지 않고 주민의사와 참여로 주민대표자를 통해서 독립적ㆍ자율적으로 처리한다는 것을 전제로 하고 있다. 이러한 점을 고려하여 볼 때 복지와 관련된 치안을 담당하는 자치경찰제에 관한 연구를 소홀히 할 수 없는 것이다. 본 논문은 첫째, 한국경찰제의 이해와 분석, 둘째, 외국의 자치경찰제 분석, 셋째, 한국경찰체제의 분석과 자치경찰제 모형, 넷째, 결혼 순으로 기술하였다. 본 논문에서는 자치결찰제 모형을 5가지로 구분하였는바, ① 국가경찰체제 분권화 모형 ② 광역자치경찰제 모형 ③ 기초자치경찰제 모형 ④ 절충제 모형 ⑤ 행정경찰모형으로 하였다. 이 중 가장 바람직한 모형으로 분석된 모형은 ③ 기초자치경찰제 모형으로서 기초자치단체인 시ㆍ군 및 자치구에 설치하는 모형이다. 이 모형은 주민과 대면행정, 생활행정 및 주민참여를 전제로 하기 때문에 직접 시장이나 군수 및 자치구청장이 지휘감독하지 못하도록 시ㆍ군ㆍ구경찰위원회를 설치하여 자치경찰임무를 수행하도록 하였다. 그러나 한편 시ㆍ군 및 자치구에도 국가경찰기능이 수행되기 때문에 국가경찰체제를 그대로 유지시키는 양체제가 동시에 수행되도록 편성하는 모형이다. 예컨데 각 시ㆍ군 및 자치구에는 ○○경철위원회를 설치하여 그 예하 ○○경찰서를 지휘감독하는 체제이다. 각 경찰서단위에는 경찰부서장제도를 두어 국가경찰기능 및 자치경찰기능수행을 각각 부서장이 직접 지휘감독하고 협조하게 하는 모형이다.

Based on the idea of freedom of making decision behavior, 'local government' means "to decide autonomously" on the "business of locality": "to decide autonomously" is to take care of the locality's own business by its delegates through its residents' opinion and participation without any restrict from other institution; "business of locality" ranges from a variety of personal to public problems like the community's administration, welfare, etc. Local government is developed as the relations between local autonomous entity and its resident, central administration and local entity, and central administration and local entity's resident are shaped appropriately. The contents of present study are: Understanding and analysis on police system in Korea; Analysis on police system overseas; Analysis on Korean police system and pattern of Local police system; and, Conclusion. There are five patterns of Local police system in the study: Decentralized national police system; Metropolitan Local police system; Basic Local police system; Eclectic method; and, Administrative police. The most desirable of the five patterns is the Basic Local police system, a pattern to set up police station in city, county or autonomous district. Since it premises the direct adminstration to resident, adminstration on life and residents' participation, the Local police would carty out its duties only after establishing a police committee of city, county or district not so as to be controlled by mayor, county headman or district chairman. Because national police will function in the city, county or district, however, the pattern would allow the two systems. For instance, each city, county or district sets up its police committee, and its police station is controlled under the command of the committee. And vice command of 2 persons in each police station gives direct instructions or supports on both national and local police functions.
