동양철학적 접근을 통한 범죄원인론 구성 및 교정처우 가능성의 예비적 연구

A Preliminary Study on the Crime Causation and Correctional Treatment Program through the View of Oriental Philosophy

이 연구는 인간의 범죄성향 및 교정처우 가능성 탐색에 관한 다음과 같은 세 가지의 관심 및 궁금중에서 비롯되었다. 첫째, 수 천년간 지혜의 소산으로 집적되어 왔던 주역, 사주, 음양오행 등 동양철학적 가치들이 근대화 이후 우리나라에 물밀듯이 밀려들어 온 서구 신문화 내지 과학화에 밀려, 막상 우리의 정서나 토양을 잘 반영할 수 있음에도 불구하고 편향적 프리즘의 사각지대에서 학문으로서의 정당한 평가를 받지 못하고 있는 것 아닌가 하는 우려와 아쉬움이며, 둘째, 동서철학의 대립 내지 긴장관계를 조정하여 유사성이나 보완성으로 조화시킬 수 있는 방법은 없겠는가? 셋째, 이런 조화의 노력과 모색은 어떠한 학문 영역에서 가장 긴요하고, 검증 가능하겠는가에 집중되어 있다. 필자는 이러한 관심을 충족시킬 수 있는 연구영역으로서 범죄원인론과 교정처우를 선택하고, 동양철학적 접근을 통한 범죄원인론 구성과 교정처우 가능성을 탐색하는 예비적 연구를 실시하였다. 그 방법론으로는 교정기관에 협조를 의뢰하여 수집된 총 100건에 대한 사례연구를 하였으며, 분석과정에서 유효표본 62건을 선정하여 생년월일시 역학 해석에 의한 정밀 분석을 하였다. 범죄유형별로는 살인범죄 8건, 강도범죄 12건, 강간범죄 14건, 방화범죄 8건, 폭력범죄 20건이다. 이 연구 조사의 기본 가설은 첫째, 인간은 자기가 고유하게 가지고 태어나는 각각의 사주에 따라 고유한 기본기질이 간직되어 있을 것이다. 둘째, 고유한 기본기질 중 일정 요소는 범죄성 또는 범죄행위에 영향을 미치는 동인으로 작용합 것이다. 셋째, 범죄성 또는 범죄행위에 영향을 미칠 수 있는 기본기질을 동양철학적 원리를 통하여 순화시킨다면 범죄적 성향 역시 순화될 수 있을 것이다는 3가지로 설정하여 이를 증명해 보고자 하였다. 분석 결과 상당히 의미있는 내용이 도출되었고, 향후 교정기관 등에서 실험집단의 시범적 운영이 이루어져 체계적인 지속적 검증 작업이 수행됨으로써 현 시점에서 가지고 있는 한계들을 극복해 나가는 진보적 실험정신과 누적적 연구 결과를 기대한다.

This Article examines an applicable correlation among SAJU as a oriental philosophy(the four pillars : year, month, day and time of birth) and criminality and whether there is a influence by personal SAJU in correctional treatment program, especially classification of the prison population. Classification in prison facilities may be thought of as a process whereby a prison population is divided into subgroups on the basis of security and program needs. This provides a mechanism for correctional officials to review and identify their population, to group them into categories, and to work with them in an efficient and effective manner toward the goal of operating a safe and orderly prison. The main assumption in this study is that if men has a different innate personality or criminality by own SAJU, these could be corrected for the use of reason corresponding to their own SAJU, which is transformed into O-HENG(five elements of oriental cosmogony : wood, fire, earth, metal and water). This study analyzed from a purposive sample of 62 cases of the prison population, was accomplished by interpretation of their own SAJU. As examined in the above, the majority of the hypotheses are proved. It is desirable that we should affitm the value of SAJU and its proper applications in our practical life as a normal scientific principle.
