성매매규제 관련법의 쟁점에 관한 연구

A Study on the Issues Regarding Punitive Laws of Prostitution

성매매 행위에 대한 규제는 개인의 인권을 보호하는 차원에서 반드시 이루어져야 하는 과제이며, 국제사회의 약속으로 인식되고 있다. 우리나라는 성매매에 대해 금지주의적 입장을 취하고 있지만, 성매매규제와 관련하여 지나치게 많은 입법으로 그 운용에 상당한 혼란을 빚고 있다. 따라서 청소년의 성매매행위와 성인의 성매매행위를 구분하여 전자의 경우는 청소년의성보호에 관한 법률로, 후자의 경우는 가칭 성매매알선 등 행위의 처벌 및 방지에 관한 법률로 통합하는 작업이 선행되어야 한다. 청소년의 성보호에 관한 법률은 청소년과의 자발적 성교행위의 처벌, 청소년 대상 강간과 강제추행 등의 친고죄적용, 자발적ㆍ적극적 성매도청소년의 처벌, 청소년의 성의 구별, 신상공개 등의 규정에 대한 정비가 필요하다. 그리고 가칭 성매매알선 등 행위의 처벌 및 방지에 관한 법률은 일부용어에 대한 명확한 개념정의가 선행되어야 하며, 또한 지나치게 중형인 처벌규정, 상습적ㆍ자의적 성판매자에 대한 처벌 및 그 정도 등에 대해 타 법률과의 형평성 및 입법취지를 반영한 조정이 있어야 한다. 자수자나 외국인, 신고보상금, 재정신청 등의 특례규정도 상당한 사전적 검토도 요구된다. 따라서 충분한 논의와 연구를 통하여 앞서 제시한 문제점들을 개선한 관련법률의 제ㆍ개정이 필요하다고 본다.

Now, we have the law named "preventive measure of an act of prostitution". However, the law is inconsistent with reality. This law focuses on controling the prostitutes It has never controlled the exploitation of prostitutes, and a vice racketeer who panders to men. The nation must prepare a new legislation to punish these law-breakers for the protection of the prostitutes.
