여성수형자 처우 개선방안에 관한 연구

A Study on the Improvement for Female Inmate Treatment

현재 우리나라의 여성수형자들은 수적 소수를 점하고 있다는 점에서 경제논리에 의해 성적 특성을 고려한 개별화된 처우를 받지 못하고 있다. 전체 범죄자 중에서 여성이 차지하는 비율이 남성에 비해 상대적으로 작기 때문에 교정시설이나 여타 다른 처우시설에서 여성들은 잊힌 존재로 지내왔다. 범죄자로서 소수집단인 여성들은 남성들과 다른 특성들을 지니고 있음에도 불구하고 경제적 논리로 인하여 남성과 동일한 처우를 받아왔다. 여성수형자들은 남성수형자들과는 다른 심리적, 신체적 특징을 가지고 있고 남성들과는 구별되는 여성재소자의 하위문화를 보이고 있지만 여성들에 대한 처우는 차이를 나타내고 있지 못하다. 따라서 이 연구에서는 여성수형자에 대한 처우가 현재 어떠한 방식으로 이루어지고 있는지 그 현황과 문제점을 파악하여 여성수형자의 특성에 맞는 처우 방안을 제시하는 데에 목적을 두었다. 또한 여성 범죄의 원인에 대한 올바른 이해가 문제 해결의 전제가 된다고 보아 그에 대해 심도 있는 고찰을 하여 성-인지적 교정의 당위성을 도출하고자 하였다. 또한 우리나라 여성수형자 처우 실태 및 문제점에 대한 개선방안으로 첫째, 소규모 여성교정시설을 증설해야 한다. 둘째, 성-인지적 처우프로그램을 확대 실시해야 한다. 셋째, 자립기반으로서의 직업훈련프로그램을 현실화ㆍ다양화해야 한다. 넷째, 가족과의 유대관계를 유지할 수 있는 프로그램을 확대해야 한다. 다섯째, 여성수형자에 대한 과학적ㆍ체계적인 분류체계를 확립해야 한다. 그리고 마지막으로 지역사회에 기초한 사회내 처우 프로그램을 적극적으로 활용해야 한다는 것을 제안하였다.

This article mainly discusses the suitable treatment programs for female inmates. Despite growing of female crime, the researches on female crime and the discussion on the suitable treatment programs for female inmates were so insufficient. In macro perspective, the cause of female crime can be the changes of gender-role that have been accompanied the expansion of participation of women in public affairs that lead to increase contact opportunities of criminalities. But in process perspective, victim, abuse, and neglect experiences result in crime commitment of female. Therefore female offender is placed both position of victim and offender. Because of this pathway, treatment on female need to approach on remedial and gender-specific point of view. However, gender-specific treatment programs of South Korea are still insignificant. Gender-specific treatment reflects desire, problem, trait, thinking processes of women, and that provides for women individualized treatment. For the improvement of female inmate treatment, increasing of small female correctional facilities, diversification of facilities and programs for female inmate treatment, realization and diversification of job training program as independence foundation, establishing of scientificㆍsystematic classification system on female inmate and practical using of community correction are necessary. Also, for programming the suitable treatment for women inmate, in academic world much more researches about character of female offender and cause of female crime have to perform. Above all, we need to change a perspective on female inmate. There should be accompany reform of consciousness of community and effort to participate on social reinstatement of inmate.
