교도소 내 인권문제에 대한 미시적 접근

현대 한국사회에서 '인권'이란 매우 가치있는 단어이다. 이는 교정에서도 예외는 아니며, 어떠한 경우라도 수용자의 인권침해는 정당화될 수 없고, 수용자라도 인간으로서 대접받는다는 점에 있어서는 차별이 없어야 하지만, 불필요한 인권시비로 인하여 정말 보장받아야 할 소중한 수용자의 인권이 침해되는 일은 반드시 줄여야 한다. 이에 본 연구는 교정시설내 수용자들이 제기하는 인권의 문제를 종전의 선행연구처럼 거시적 시각과는 달리 인권논쟁의 당사자의 특성에 초점을 둔 미시적 관점에서 접근하였다. 그 결과 교도소 내에서 인권문제를 주로 야기하는 수용자들에게는 그들 만의 개인적ㆍ심리적 특성이 발견되었다. 이런 문제를 해결하기 위해서는 교도소내 인권연구 전략의 개선, 교도소개방화의 가속화, 인권쟁점 중재장치의 설치, 수용자 인권의 허용범위 설정, 교도소내 인권교육의 정착화, 여성수용자처우시스템의 설치, 교정심리프로그램의 개발 등이 요청된다.

The word, 'rights' is much valued in the modern Korean society. Thee is no exception in the field of corrections. Any violation of inmates' rights should not be judtified in any circumstances. Although inmates should not be discriminated against their rights because they deserve to br treated as any other human beings, we should be able to find out some ways to reduce the violations of valuable rights granted to inmates due to unnecessary or unjustifiable petitions by inmates. In this sense, unlike other precedent studies with macro-level approaches focused on the natures of human rights violations raised by inmates, this study employes the micro-level approach which focuses upon the characteristics of those inmates who have petitioned that their human rights have been violated. This study has confirmed that those inmates who has petitioned the violations of their rights was found to have distinctive psychological and individual characteristics different from other inmates who do not petition. Based upon these results, various strategies to cope with these issues could be strongly suggested. These policy implication strategies should include the reform of human rights research methods in prison, the axcelleration of openning the prison, the establishment of mechanisms to mediate human rights conflicts in prison, the establishment of clear limits on guaranteed inmates rights, the strengthening od human rights education in prison, the introduction of special treatment programs for female inmates, and the development of correctional psychology programs.
