토지비축제도의 효율성 제고방안

토지는 국민 경제활동의 기반이자 중요한 생산요소임에도 불구하고, 토지비용에 따른 보상가의 상승은 사업지연의 악순환을 고착화시켰다. 이러한 문제점을 해결하고자 도입된 토지은행, 즉 토지비축제도는 공공부문에 의한 토지수급관리 시스템을 구축하여 공공의 토지비축 및 공급을 통한 시장조절, 투기억제 및 지가안정을 목적으로 한다. 이 연구에서는 토지비축제도의 효율성을 제고하기 위하여 종합적인 관점에서 토지비축제도의 일반이론과 현행 토지비축법의 구조를 살펴봄으로써 나아가야 할 방향을 정립하고, 이를 토대로 법제적ㆍ정책적 측면, 그리고 타 제도와의 연계를 통한 효율화 측면으로 나누어 입법론을 제시하였다. 지금까지 토지비축에 관한 수많은 연구들이 이루어져왔지만, 토지비축제도를 실제로 시행ㆍ운영하는데 있어 필요한 측면들을 현실적인 상황에 맞추어 종합적으로 분석한 사례는 미약하다. 토지비축제도의 조기정착을 위한 효율성 제고는 법제적인 측면의 개선방안 뿐만이 아니라, 정책적 측면, 그리고 연계가능한 제도의 도입을 통하여 이루어 질 때, 그 목적을 달성할 수 있을 것이다. 또한 현재 제기된 문제점 분석뿐만이 아니라 앞으로 제기 될 수 있는 문제점에 대한 도출이 필요하며, 제도가 형식뿐이고 가치나 의의가 없는 것이 되지 않도록 더욱더 많은 관심과 연구가 필요하고 생각된다. 이러한 종합적인 노력과 연구가 토대가 되어 토지비축제도의 효율성이 제고될 때, 고착화된 토지문제를 해소할 수 있을 것이다.

Despite the fact that land is the foundation of people s economic activity and an important productive factor, increase in compensation of the land caused by booming land price stick vicious circle of business delay. Land bank that has been introduced to solve these problems, namely land banking system is the purpose for control market, controling real estate speculation, and stable land price through public land banking and supply. This study established new direction by reviewing structures of general theory of the land banking system and current land banking law from comprehensive angles to improve effectiveness of the land banking system, and suggested theory of legislative divided into legal aspect, policy aspect, and effectiveness aspect through connection with other institutions based on the new direction. Although a lot of studies for land banking has been done so far, cases that analyzed comprehensively aspects which are necessary to implement and operate the land banking system in line with practical situation are deficient. Increase in effectiveness of the land banking system for early settlement can attain the purpose if it is introduced through improvement of legal institution and policy aspect as well institutions that could be linked with others. In addition, it is essential to not only analyze current suggested problems but also elicit suggesting problems, and to be more interested and study in the land banking system so as not to make it become unmeaning and formality. Permanent land problems would be resolved if effectiveness of the land banking system is increased based on these comprehensive efforts and studies.
