외국인 범죄수사의 실태분석 및 개선방안

Actual Analysis and Improvement Methods of Police Investigation of Foreigner Crime

이 연구의 목적은 외국인범죄에 대한 경찰수사활동의 실태를 분석하고, 경찰이 더욱 효율적으로 외국인 범죄수사를 행할 수 있도록 그 개선방안을 제시하고자 하는 것이다. 외국인 범죄수사를 합리적으로 행하기 위해서는 다음과 같은 개선방안을 실행에 옮길 필요가 있다. 첫째, 외국인 범죄처리에 대한 복잡한 관련법규를 정비해야 한다. 이를 위해서, 일원화된 법규정을 제정하고, 효율적인 수사기법의 근거규정을 마련하고, 외국인범죄 관련 서식을 연구·개발하여야 한다. 둘째, 수사조직 및 수사요원의 전문성을 확보하여야 한다. 이를 위해서, 수사조직의 독자성을 강화하고, 외국인범죄수사 전문요원을 확충해야 한다. 셋째, 국내·외 관련기관간 공조체제를 강화하여야 한다. 이를 위해서, 국내 유관기관과의 협조체제를 강화하고, 국제 공조수사를 강화하여야 한다. 넷째, 체계적으로 외국인범죄 정보를 수집·분석하여야 한다. 이를 위해서, 외국인 범죄에 대한 정보를 사전에 수집하고, 정확한 신상정보를 수집·정리·수정하여야 하고, 지문 등 신상정보를 채취하고, 범죄경력을 체계적으로 관리하여야 한다. 다섯째, 효율적으로 외국인 범죄수사를 행할 필요가 있다. 이를 위해서, 지역경찰관에 대해 관련 교육을 실시하고, 조직·지능범죄에 대한 기획수사를 실시하고, 외국인 범죄수사관련 매뉴얼을 작성하고, 유능한 통역요원을 확보하고, 외국인 참고인의 협력을 확보할 수 있어야 한다. 여섯째, 외국인 피의자에 대해서 인권 존중적인 수사를 행할 필요가 있다.

The purpose of this study is to analyze the actual condition and present the improvement methods of police investigation of crime by foreigners. To execute police investigation of foreigner crime efficiently, the following improvement methods should be practiced. The first, complex regulations should be revised. Specially, we should establish the unified regulation, enact the source regulation for effective crime investigation, and develop the related paper formats. The second, the investigation organization and agents should be specialized. Specially, we should strengthen the investigation organization, increase the number of the related investigation agents. The third, the mutual cooperation between the related institutions, nationally or internationally, should be reinforced. The fourth, the related intelligence should be collected and analyzed systematically. The fifth, the crime investigation should be executed efficiently. Specially, we should educate the community policemen, execute the planning investigation with regard to organizational crime and intellectual crime, make the investigation manual, secure the competent interpreter, and guarantee the cooperation of the foreign witness. The sixth, the human right of the suspected foreigner should be guaranteed.
