A Study on the Behavior Tendencies of Korean Demonstrator and the Korea National Police's Demonstration Control Tactics

오늘날 전 세계에 걸쳐 개인적 욕구와 집단적 목적 달성을 목적으로 많은 집회와 시위가 발생되고 있다. 경찰은 합법적인 집회와 시위에 대해서 존중하고 배려하면서 이를 보장해 주어야 한다. 그러나 한편으로 경찰은 이러한 측면뿐 아니라 만일 집회와 시위 중에 불법적 행위가 발생한다면 사회의 질서와 안녕을 유지하고 보존하기 위하여 이를 진압하거나 이를 통제하여야 하는 공공적 책임을 가지고 있다. 이것은 경찰이 보유하고 있는 매우 중요한 책임과 역할이라고 할 수 있다. 한국에서는 지난 수십 년에 걸쳐 심각하고 폭력적인 집회와 시위의 발생이 일반적인 사회현상의 하나로 자리매김하여 왔다. 한국국립경찰은 지난 수십 년간 사회질서를 파괴하기위해 이를 위협하는 폭력적 시위진압에서 매우 중요한 역할을 해 왔다. 몇 년전 한국경찰은 화염병 시위문화를 종식시키기 위하여 무 최류탄 원칙을 발표하여 시위통제 정책에 하나의 신기원을 제시하였다. 이러한 원칙은 지금까지 비교적 잘 지켜지고 있다. 그러나 이에 반해 시위에 참가하는 많은 한국인들은 화염병을 사용하고 있는 실정이다. 더욱 더 경찰을 어렵게 하는 요인들은 점차적으로 증가하고 있다. 그 중 대표적인 것이 경찰의 시위진압정책 등이 정치적 영향 하에 있다는 사실이다. 그리고 현실적으로 체포된 시위자들에 대한 처벌의 미약성 등 역시 일조를 하는 것으로 보인다. 그러므로 한국에서의 시위현상은 점차적으로 폭력적으로 되거나 심각하고 불법적인 경향을 띄고 있다고 해도 과언이 아니다. 본 논문은 한국에서의 시위참가자들의 경향과 정치적 영향을 포함하여 경찰 시위정책에 영향을 미치는 요소, 그리고 한국에서의 시위 현상과 환경 등을 포함하여 한국 경찰의 시위 전술에 대하여 살펴보고 이에 대한 정책적 제언을 하고자 한다.

Throughout today's world, there are many assemblies and demonstrations being held for the purpose of personal profits and group goal accomplishment. Police should guarantee legal assembly and demonstration with respect and consideration. However, police also have responsibility to control demonstrators, and if they recognize illegal behavior during demonstration, they should repress it in order to preserve public order and safety. This is one of the important roles of police. In Korea, severe and violent demonstrations are common social phenomena and have been taking place for many years. The Korea National Police has played an important role in controlling violent demonstrations that threatened to destroy the social order in recent decades. A few years ago, Korea National Police announced an epoch-making demonstration control policy: "No bottle grenades, no tear gas." Even now KNP maintains the "No tear gas" policy. However, demonstrators don't keep their end of this promise. To make matters worse, police policy regarding control of demonstrations is affected by political influence. And punishment of arrested demonstrators seems to be lenient. Therefore, the phenomena of demonstration in Korea have become more violent, severe and illegal. This paper will discuss the tendency of Korean demonstrators' behavior, influential factors in the police demonstration policy, including political influence, the phenomena of demonstration in Korea and countermeasures.
