음주교통사범 수강명령의 효과에 관한 연구

음주운전으로 인한 재산 및 인명피해는 날로 심해져가고 있다. 그럼에도 불구하고 이에 대한 처벌이 벌금형으로 미약하고 그로 인한 심각성에 대한 경시로 음주재범이 늘어나고 있다. 현재 보호관찰 중 수강명령이 대다수 음주교통사범에게 부과되어지고 있다. 하지만 음주교통사범에 대한 보호관찰(수강명령)이 획일적으로 이뤄지다 보니 그 효과성에 문제가 발생하고 있다. 특히 음주교통사범에 대한 수강명령 프로그램 운영 의 융통성 부족과 수강명령 등을 집행할 전문성 있는 전담직원 부재 등은 수강명령을 형식화로 이끌어 수강명령의 효과를 반감시키고 있다. 나아가 수강명령이 단순히 단독부과형태로만 이뤄진다는 것이다. 이 연구 분석 에서와 같이 단독수강명령이 가장 많은 재범율을 보이는 것은 이를 증 명하는 것이라 하겠다. 또한 수강명령의 재범율이 6개월 이내가 가장 높은 것은 바로 초기에 보다 적극적인 수강명령집행이 이뤄지지 못하기 때문이라 하겠다. 그러므로 향후 음주교통사범 보호관찰 대상자들의 재범방지를 위해서는 인력과 예산을 확보하여 처우의 전문화가 이뤄져야 할 것이며, 이는 프로그램 활성화와 음주운전에 대한 인식전환, 교통사범의 특성을 고려한 분리집행 등을 통하여 효과적인 수강명령을 실시하여야 할 것이다. 나아가 다양한 처우의 확대를 통해 최적의 보호관찰을 실시하여야 할 것이다.

Alcohol is a major factor in traffic accidents. Drunk-driving is responsible for a large number of deaths, injuries, damage and accidents every year. In most international jurisdictions, anyone who is convicted of injuring or killing someone while under the influence of alcohol or drugs can be heavily fined, as in America, in addition to being given a lengthy prison sentence. But effect of a punishment was lost on drunk-driver. The purpose of this program announcement is to stimulate research that addresses the problem of recidivism among people convicted of drinking and driving offenses. Attendance center order is a system where an order is given to a criminal who was engaged in habitual addictions that are regarded as crimes to receive lectures in the probation & parole office or other organizations designated by the probation & parole office for a certain period of time, while leading a free life, instead of being accommodated in the prison. The results of this study showed that single attendance center order had a great recidivism. Also the recidivism of attendance center order was revealed highly in six month. In programme performance, the better results would be expected if the period the attendance center order is not performed en masse but extended and regularly.
