전과자에 대한 일반시민과 형사사법 종사자의 인식차이에 관한 연구

A Study on Differences in the Perception of Ex-convicts between the Public and Criminal Justice Professionals

이 연구는 일반시민과 형사사법 종사자 간의 전과자에 대한 인식의 차이에 대해 알 아보기 위하여 전과자에 대한 사회적 허용도와 태도, 전과자 차별의 제 차원에 대한 부당성 정도, 범죄자 관리제도에 대한 의견, 그리고 전과자의 재범 및 교정가능성 등에 대해 서 알아보기 위하여 전국의 성인남녀 250명 과 경찰ㆍ교정ㆍ보호관찰직에 종 사하는 형사사법 종사자 200명 을 대상으로 조사하였다. 분석결과, 형사사법 종사자 들의 의견은 전반적으로 일반시민의 의견과 경향성에서는 유사하지만 비율을 보면 상대적으로 일반시민보다는 전과자에 대해 부정적인 인식 을 갖는 경향을 보이고 있다. 또한 범죄자 등록제도나 범죄경력조회 등 범죄자 관리와 재범예방을 위해 도입되었거나 도입예정인 제도들의 전과자 차별 또는 인권침해 여부에 대한 조사결과도 마찬가지로 일반시민의 경우보다 이런 제도들이 범죄자를 차별하는 것으로 보는 형사사법 종사자 의 비율이 낮은 것으로 나타났 다. 뿐만 아니라 범죄자의 교정가능성과 교정가능 범죄유형에 대한 의견을 종합해 보면 두 집단 모두 일부 범죄자만이 교정 가능하다고 보고 있다. 이러한 점에서는 두 집단간의 의견이 유사한 측면이 있기는 하나 전체적으로는 일반시민의 경우가 형사사법 종사자 보다 전과자의 교정가능성에 있어서 긍정하는 경향이 강한 것으로 나타났 다. 특히, 형사사법 종사자 의 직종간 인 식차에 있어서도 대부분의 문항에서 교정직 종사자의 경우가 전과자에 대한 부정적 인식 이 강하게 나타나는 것을 알 수 있었으며, 보호관찰직 종사자의 경우가 전과자 에 대해 서 비교적 유연한 인식 을 가지고 있는 것으로 나타나고 있다.

This study was intended to clarify any differences in the perception of and attitude towards ex-convicts between the public and criminal justice professionals regarding the level of unfairness in all the aspects of discrimination against ex-convicts, views on criminal control regime and the possibility to correct criminals. In result, it was found that more criminal justice professionals tended to have negative perception of ex-convicts compared to the public, although the relevant views and tendencies were generally similar between the former and the latter. Further, as a result of investigating whether the criminal control regimes introduced or planned to be introduced for the sake of criminal control and second-offense prevention including criminal listing system or criminal history information reference may discriminate against ex-convicts or violate their human rights, compared to the public, less criminal justice professionals viewed that such the regimes discriminate against ex-convicts. Putting together their views on the possibility to correct criminals and the types of correctable crimes, both the groups viewed similarly that only some criminals would be corrected. In particular, correctional officers of criminal justice professionals tended to have remarkably negative perception of ex-convicts in response to a majority of the given questions with regard to differences in the perception among their job series.
