최근 우리나라 소년범죄현상에서 특히 우려되는 현상은 소년범죄자들이 과거와 같이 일회성 비행에 그치지 않고 2범, 3범 등 상습적으로 범죄에 빠져드는 경향이 증가한다는 것이다. 이에 본 연구는 소년범죄의 상습화현상을 유발하는 원인의 하나로 우리나라 소년범죄자 처우방법이 시설내처우와 보호자감호의 보호관찰에 의존할 뿐 중간단계 처우방법이 없기 때문이라고 판단하고 병영훈련프로그램을 소개하고 이러한 처우방법을 우리나라에 도입하고자 했을 때에 검토해야 할 주요사항을 정리하였다. 외국의 경우에 병영훈련프로그램은 범죄자의 재활, 재범억제, 시설과밀화 문제의 완화, 교정처우비용의 절감 등에 기여할 수 있다는 기대효과로 인하여 많은 관심의 대상이 되었으며 최근에 들수록 여러 지역에서 적극적으로 활용되고 있다. 우리나라에서도 병영훈련프로그램을 도입하여 그 기대효과를 효율적으로 구현하기 위해서는 1) 군대식 준율교육, 사회봉사활동과 체력단련훈련, 재활교육과 학과교육, 강도높은 사후관리들을 체계적으로 구성하여 교육과정을 내실화하고, 2) 약식처벌의 부과절차에 관하여 사전에 명확한 지침을 마련하여 훈련교도관에 의한 약식처벌이 남용되는 것을 방지하여야 하며, 3) 법원과 교정기관이 협조하여 대상자를 선정할 수 있는 절차를 마련하여 프로그램에 적합한 대상자들에 활용될 수 있도록 하고, 4) 훈련교도관에 대해서도 별도의 교육과정과 보상절차를 마련하여 훈련교도관들이 대상자들에 역할모형이 될 수 있고 밀접한 상호작용관계를 맺을 수 있도록 해야 할 것이다.
Correctional boot camp refers to a treatment method which emphasizes military drill and ceremony, separation of the participants from general prison population, requirement of social work and physical training, implementation of rehabilitation classes, and intensified after-care. This program began in the state of Georgia, America in 1983. In the years since there has been an enormous growth in the number of the programs due to the program's various expected effects on recidivism, rehabilitation, prison overcrowding, and correctional costs. This study illustrates the basic features and operational details of correctional boot camp. In addition, it discusses several caveats when the correctional officers of Korea intend to implement such a program to deal with chronic juvenile delinquents. This study considers that systematic arrangement of program components, pre-established regulations for summary punishment, close cooperation between courts and correctional officers in selecting program participants, and provision of training sessions and rewards for drill instructors are major issues in achieving the expected effects of the correctional boot camp.
